Statement from Gov. Shapiro on Today’s Decision from the PA Supreme Court 03/26/2026

"Today, Pennsylvania’s Supreme Court ruled that mandatory life sentences without the possibility of parole for second degree murder are unconstitutional.

"I have long believed this law is unjust and wrong. As Governor, I took legal action in this case arguing to strike down this sentencing framework.

"Common sense and true justice dictate that we need different penalties for different conduct. For example, the getaway driver shouldn’t get the same sentence as the person who pulls the trigger.

"Per the Supreme Court’s order, it is now time for the General Assembly to act and come up with a thoughtful, just process to address those who are serving life sentences for second degree murder."

Governor Kay Ivey has just granted clemency to Charles "Sonny" Burton in Alabama. Gov. Ivey is quoted by WSFA 12 News saying,

“I cannot proceed in good conscience with the ex*****on of Mr. Burton under such disparate circumstances. I believe it would be unjust for one participant in this crime to be executed while the participant who pulled the trigger was not."

Save Sonny

Charles "Sonny" Burton is a 75-year-old grandfather, is wheelchair bound, and is set to be executed by gas chamber on March 12 despite not having killed anyone.

Sonny is imprisoned in Alabama, a state which has already carried out 49 ex*****ons in the last two decades.

Sonny didn’t kill anyone—he was at the scene of a murder during a robbery and was charged under the state’s felony murder law. The death sentence of the actual shooter has already been overturned, so why do we even have to plead with Governor Kay Ivey to show mercy in this case, and commute his death sentence? But that’s where we are.

The death penalty is racially biased, racially motivated, discriminatory, and flawed, and it has largely been Black people who have been subjected to this cruel and unusual punishment.

We are urging Alabama Governor Ivey to stop this reckless ex*****on and join us in the fight for a nation no longer plagued by state-sanctioned killings. Let’s fight for Sonny together:
