You carry out the work. No written instruction. No signed variation order. No revised pricing.

Project completes. You submit your final account with an additional **R 187,000** for the variations.

The client responds:

*"We never agreed to that price. We're only paying the original contract sum."* ๐Ÿ˜ค

Does the contractor get paid for the variations โ€” and what should he have done differently?

No. In most cases, the contractor does NOT get paid** โ€” or faces a long, expensive legal battle to recover the money.

Here's why:

Under **GCC, JBCC and NEC3 contracts** โ€” the three most common standard forms used in South Africa โ€” a variation is only valid when:

โŒ It is **instructed in writing** by the principal agent or engineer
โŒ It is **priced and agreed** before the work is carried out
โŒ It is **captured on a signed Variation Order (VO)** with a revised contract value

The contractor carried out **R 187,000 of work on a verbal instruction.** Without a signed VO, the client's legal team will argue:

- The work was included in the original scope
- The price was never agreed
- No instruction was formally issued
