Twenty-five years later, we remember the lives lost on September 11, 2001, and the extraordinary courage of those who stepped forward to help.

The ABA’s 2026 update to Model Rule 1.14 is more than a terminology change. Retitled “Client with Decision-Making Limitations,” the Rule places greater emphasis on client autonomy, lawyer-client communication, and protective actions that are both necessary and proportional.

For lawyers and law firms, four risk management priorities stand out:

• Maintain lawyer-client relationship as far as reasonably possible.
• Use supported decision-making and accommodations suited to the client’s needs.
• Explore less restrictive alternatives before pursuing guardianship or conservatorship.
• Document communication efforts, accommodations tried, and alternatives considered.
