The U.S. Supreme Court has finalized the legal boundary for digital creativity by declining to review a case that sought copyright protection for artwork generated entirely by artificial intelligence. The move solidifies a 2022 decision by the U.S. Copyright Office and subsequent lower court rulings, which determined that the term "author" in federal law applies exclusively to human beings. The specific case involved a visual piece titled "A Recent Entrance to Paradise," which computer scientist Stephen Thaler claimed was autonomously created by his AI system, DABUS.

By refusing to hear the appeal, the justices have left the legal framework for the creative industry unchanged during a period of rapid AI expansion. The current administration had specifically urged the court to decline the case, arguing that while AI is a sophisticated tool, the act of "conception" remains a uniquely human endeavor. This decision creates a clear distinction between purely machine-generated outputs and "AI-assisted" works, where human creators may still qualify for protection if they can demonstrate significant and "sufficiently creative" human input.
