The Mahalo Realty would like to share information about The National Association Of REALTORS Rules and Regulations Unraveled

We are into the "new world' and the rules that are now in place as a result of the settlement stemming from the lawsuit against the National Association of REALTORS, we wanted to clear up some misinformation that is floating around out there as it relates to representation when you are buying or selling home. The news media certainly hasn't helped the situation, so as always, it's best to get the real story from people who work in the industry:

1. If I list my home for sale or lease, is it true that I don't have to pay a buyer's representative? Yes, and this has always been the case as this has always been negotiable. But...offering cooperative compensation is to a seller's advantage. The buyer's representative can play a key role in getting your home sold and that representative can be of significant value in the transaction process. Again, we reiterate, this is negotiable. How much (if any at all) you pay and how you pay can be discussed during your listing consultation.

2. If I am buying a home, is it true that I have to sign a representation agreement just to see a home? Yes, you have to sign a representation agreement. But, there are options as far as what you sign, especially if you are not comfortable with committing to a "long term" relationship. If you are in the market to purchase a home, we are more than happy to discuss these options with you to make you feel more comfortable.

3. If I attend an open house, will I have to sign a representation agreement before touring the home? Absolutely not. The agent hosting the open house is working on behalf of the seller and you do not need to sign anything. If you decide to purchase that home, it is up to you if you want to hire representation. Saying that, we always recommend that you have representation when you do decide to purchase a home.

4. If I purchase a home, do I have to pay to have an agent represent me? That answer is maybe. Real estate agents don't work for free and hiring representation is recommended because having someone help you through what can be a complicated and complex process is going to benefit you. The source of compensation for the buyer's agent can vary and this is written into the representation agreement. Again, there are options and we are happy to discuss those with you.
