The 5 Things That Break When You Grow: What happens to your firm when the caseload doubles but the team doesn’t?

For most trust & estate practices, growth quietly erodes the client experience — the silent killer of referrals and recurring revenue. In this free Speaker Series session, Isabella Hughes walks through the five things that break when a T&E practice scales, and how to build a workflow that holds up under pressure. Plus a live look at how real firms cut hours per file by 53% and more than doubled the trusts they complete — without hiring.

Today: The 2/37 Haircut for Trusts and Estates

Three of the field’s leading authorities tackle the new fiduciary tax question everyone’s asking.

The Joint Committee on Taxation report is out, Footnote 102 is generating real debate, and the practical question won’t wait: how do you advise clients while the application of the “2/37 haircut” stays uncertain? In 55 minutes, Jonathan G. Blattmachr, Robert S. Keebler, and Martin M. Shenkman give you the technical insight and concrete strategies to respond — including drafting considerations and fiduciary frameworks you can put to work right away. A certificate of attendance is provided.

Phantom Income Is the Part That Should Worry You. What happens when a trust owes tax on income it never actually keeps?

That’s the scenario at the heart of the “2/37 haircut.” If Section 68 limits fiduciary deductions, the math stops working the way Subchapter J intended: income distribution and charitable deductions erode, the trust or estate reports phantom income, and the economic balance between income and remainder beneficiaries quietly shifts. QTIP trusts, credit shelter trusts, and long-term charitable structures are especially exposed — and in multi-entity “daisy chain” arrangements, the distortion compounds at every link. This Friday, Blattmachr, Keebler, and Shenkman walk through the drafting and fiduciary decision-making frameworks to get ahead of it.

It’s Not a Capacity Problem

Most trust & estate attorneys think they need more hours in the day. They actually have a process problem.

Adding more clients without the right systems doesn’t create growth. It creates chaos. On Wednesday, June 10, attorney Isabella Hughes (Co-Founder & CEO of EstateMin, former international boxer, and Irish Times 30 Under 30 honoree) breaks down why scaling breaks T&E practices, and what the firms doing it successfully are doing differently. You’ll see a live demo of how firms cut hours per file by 53% and more than doubled trusts completed — same team, no increase in payroll.

A New JCT Report Just Changed the Fiduciary Tax Conversation. A single footnote in a brand-new Joint Committee on Taxation report could quietly rewrite how trusts and estates are taxed.

The newly released JCT report — and its now much-discussed Footnote 102 — raises a question planners didn’t see coming: does Section 68’s “two-thirty-sevenths haircut” reach into fiduciary income tax? If it does, distribution deductions under §§ 651/661 and charitable deductions under § 642(c) could shrink, leaving trusts and estates with phantom income no one planned for — and exposing fiduciaries to fresh allocation disputes and risk. On Friday, June 5, three of the most respected authorities in the field — Jonathan G. Blattmachr, Robert S. Keebler, and Martin M. Shenkman — break down what the report actually says and what it means for your clients.
