Are LifeWays Board members employees?

This question comes up because federal tax law and public governance laws use the term "employee" differently.

For federal tax withholding purposes, the IRS classifies public officials serving on governmental boards as employees. As a result, Board member compensation is processed through payroll and applicable taxes are withheld.

However, Board members are not LifeWays staff employees. They serve as public officials responsible for governance and oversight and are not eligible for employee benefits such as health insurance, paid leave, or pension benefits.

How are LifeWays Board members compensated?

LifeWays Board members receive a $70 per diem for approved meeting days and may be reimbursed for mileage at the current IRS rate.

Board members do not receive a salary or LifeWays employee benefits.

How are LifeWays Board members selected?

LifeWays is governed by a 12-member Board appointed by the Jackson and Hillsdale County Boards of Commissioners in accordance with the Michigan Mental Health Code, the LifeWays Interlocal Agreement, and LifeWays Bylaws.

Board membership includes representation from consumers, family members, county commissioners, and community representatives. State law also establishes requirements for consumer representation and limits the number of commissioners who may serve.
