Most states fail education obligations to special needs students: So, what else is new? For children with disabilities, a public school education should not be this difficult to have access to.

The Office of Special Education Programs (OSEP) for the US Department of Education recently found the Virginia Department of Education was in NONCOMPLIANCE in several key areas of their implementation of Part B of the IDEA. This includes Independent Educational Evaluations (IEE), Mediation, Due Process hearings, the list goes on. As a resident and an attorney practicing in Virginia, this is both a validation of the experiences shared by many parents as well as a serious concern regarding how our cases have been handled by VDOE. We must continue to hold the State and Local Education Agencies (school districts) accountable and fight for our children's right to a Free and Appropriate Public Education.
