A conviction for a 1st time DUI offense is a minimum $250 fine & license revocation for 1 year. Do you think it should be higher?
Do you think the driving age should be higher than 16? Why or why not? 🤔
How do you feel about red light cameras? Are you for or against them?
So many people think that hiring a lawyer is only for when you are going to file a lawsuit.

Does that mean I file lawsuits?
👉 Sometimes.

But only when settlement negotiations have failed. And only when my client and I have had a full conversation about whether litigation is advisable.

The reality is that the majority of the time a lawsuit is not necessary.

🧐 So what do I do for my clients?

⭐️ Identify all the sources of insurance coverage for them. It's not just the auto liability policy for the at-fault driver.

⭐️ Communicate with the insurance companies on their behalf so they can focus on healing. Insurance adjusters know how to put the pressure on to settle quickly with folks who don't have legal representation. But, when the injured person has an attorney, the insurance company is only allowed to contact the attorney; so, the injured person doesn't have to feel dread or stress when they see the insurance company's name on their caller I.D.

⭐️ Take the stress out of navigating and negotiating their claim. I educate and inform my clients about their claim, what is considered in determining claim value, the strengths and weaknesses of their specific claim, and their role in negotiations.

⭐️ Investigate and determine the validity of any claim for reimbursement that a health insurance carrier might make. There are certain circumstances wherein a health insurance carrier has a legal right to be reimbursed when the personal injury claim is resolved. I educate and inform my clients about these considerations and force the health insurance carrier to produce proof of their qualifications for reimbursement.

These are just some of the things I do for my clients in every single case. If you know someone in Virginia who has been injured in a car accident, please share this post.

Sadly 827 people lost their lives in Virginia by automobile accidents in 2020.

Many of these accidents can be attributed to a just a few driver errors:

☑️ Driver inexperience
☑️ Driver distraction
☑️ Driver intoxication or impairment

Here are a few tips to consider to increase road safety:

1️⃣ Wear a seatbelt. Using safety restraints can significantly reduce your risk of injury if an accident does occur.
2️⃣ Put the phone away. No one should be using their cell phone while driving. In fact, it’s against the law in Virginia for a driver to be holding a cell phone!
3️⃣ Don’t speed or run yellow lights. Speed is a factor in a large percentage of vehicle crashes.
4️⃣ Don’t drink alcohol or use drugs (including prescription) and drive

Following these tips will reduce some of the greatest risk factors that lead to a serious or fatal crash.

Do you have anything to add to this list?

"The driver on the highway is safe not when He reads the signs, but when He obeys them."

9/11/01 - I lived in an apartment building located outside the gates of Henderson Hall, a Marine base, and next door to the Navy Annex in Arlington, VA. 800 yards down the street was the Pentagon.

I had a court hearing in Alexandria that morning. After the hearing, I stopped in a shop on the way back to the car. The salesman was listening to the radio. The radio announcer was talking about people jumping out of windows in New York.

I got in the car and drove up the GW Parkway, heading home. I came around a bend in the road and suddenly there was smoke in the air over the Pentagon.

My heart dropped. We were clearly under attack.

Traffic was at a standstill. I had to leave my car in Crystal City and walk the rest of the way home. Cell phones weren’t working. Marines with machine guns were posted around the perimeter of the Pentagon and outside the Marine base. The air was full of smoke and the Pentagon was on fire.

The plane had streaked right over my apartment on its final descent into the Pentagon. Sandra Teague was on that plane. We learned Sandra’s fate while her boyfriend watched tv with us in our living room that day.

Frank had dropped Sandra at Dulles that morning for the first leg of her dream vacation to Australia. I struggle to think of how panicked and terrified she must have been on that plane.

I remember how numb, shocked, and terrorized we felt. I remember watching tv footage on repeat all day showing the jet hitting the South tower. I remember wanting to do something. Anything. But there was nothing to do except sit on the couch watching the news unfold with the Pentagon burning down the street.

I remember. What about you? Share your memories in the comments below.

What's the most frustrating thing drivers do that upsets you the most and why? 👇
You should always pursue a personal injury case as soon as possible as you only have a limited amount of time available to do so.

In Virginia, the BASIC statute of limitations on personal injury claims is two years from the date of the accident. (** There’s always exceptions and considerations that might alter this, like if your claim is against a governmental entity or if the injured party is a minor.)

The Statute of Limitations is the deadline for when a person must file a lawsuit in order to preserve their rights to make a financial recovery. So, if the claim has not been settled and a lawsuit has not been filed by that deadline, then the injured person’s rights to make a claim ARE FOREVER EXTINGUISHED.

As your kids head back to school, it’s a good time to review walking rules with them.

Back to school was always one of my favorite times of the year. It's a time for a new classroom, new teacher, new desk, new fashion(!), and the opportunity to create new friendships or rekindle old ones. It always felt like a fresh start.

Whether your kids are walking to the bus stop, to school, or simply through a parking lot, now is a great time to refresh their memory of good walking etiquette and safety.

A shocking 44 kids EVERY DAY are hit by a car while walking in the United States. That’s 16,000 kids hurt every year.

Let's do our best to curb that alarming statistic. Like, save and share this post so we can reach as many families as possible.

How to avoid pedestrian accidents?

We've got you covered! Check out our top 3 safety tips for pedestrians to stay protected on the streets.

Tip 1: Look, Listen, and Look Again.

Always look both ways before crossing the street, even at designated crosswalks or traffic lights. Stay alert and be cautious of distracted drivers. Make eye contact with them to ensure they see you before stepping off the curb. Safety starts with being aware.

Tip 2: Stay Visible, Stay Safe.

When walking at night or during low-light conditions, make yourself as visible as possible. Wear reflective clothing or accessories and carry a flashlight. This helps drivers spot you more efficiently and reduces the risk of accidents. Your safety is worth shining a light on.

Tip 3: Ditch the Distractions.

Put away your electronic devices while walking. Texting, scrolling, or talking on the phone diverts your attention from your surroundings and can lead to dangerous situations. Stay focused, keep your eyes up, and be aware of your surroundings. It's essential to arrive safely at your destination.

Let's make pedestrian safety a priority. Share these tips with your friends and family to spread awareness. Read more in:

Confused about the difference between a 'claim' and a 'case' in personal injury law?

A 'claim' is your initial step, where you seek compensation directly from the at-fault party's insurance. It's a negotiation phase, no courts are involved.

If this doesn't resolve things, you escalate to a 'case', which involves legal proceedings in court.

For those hesitant about starting the process: know that many claims are settled amicably without ever seeing a courtroom.

But here's the golden tip: with a personal injury attorney by your side, you stand a much better chance of securing a larger compensation, whether it's through a claim or a case.

If you're hesitant about the process, please reach out. We offer free consultations and you do not pay any legal fees until a settlement is reached.

Exploring estate planning options? Let's talk Wills vs. Trusts 📜🔒.

A significant difference is the probate process. Wills typically go through probate, where courts oversee the asset distribution, making it a public affair. Trusts usually sidestep this, allowing for a quicker, private transfer of assets.

On the topic of when they become effective, wills only spring into action upon one's death. Meanwhile, trusts can start immediately or at specified events, such as the grantor's incapacitation.

Parents, take note. While wills allow you to name guardians for minor children, trusts don't have this provision.

Navigating these choices can be complex, but understanding the distinctions ensures you're well-equipped to make informed decisions.

As we approach the beginning of the school season, here’s your reminder to pay attention to school buses and to watch out for children heading to and from school.

✔️ Observe School Bus Signals: School buses are equipped with flashing lights and a stop sign, which alerts both drivers and pedestrians to stop and not proceed with their movements until it is safe to do so. When approaching a school bus, watch out for these signals and abide by their instructions.

✔️ Allow for Enough Time: Buses tend to follow specific routes and schedules, and due to their size and number of passengers, they require more time and space than regular cars. Drivers should plan ahead and leave earlier, so they do not have to rush or be late for work while being considerate of buses on the roads.

✔️ Stay Alert: Children can be unpredictable, and they often have impairments when it comes to understanding traffic laws and common safety practices. Drivers should always be on the lookout for potential hazards and use caution when driving near a school bus.

✔️ Obey Traffic Laws: Always adhere to the speed limit and stop signs when driving near schools or buses. Be sure to watch your surroundings and follow traffic laws in order to protect yourself and others.

✔️ Be Patient: School buses make frequent stops and take longer to move through traffic. Be patient and wait for the bus to move along with the flow of traffic. Do not attempt to maneuver around a stopped or moving school bus. It is essential to give them the space they need to maintain safety and order.

By following these tips, drivers can do their part in keeping children safe while they travel to and from school on buses.

If you or a loved one has been injured in a car accident caused by a distracted driver, please call our office for a consultation. We may be able to help you get the compensation you deserve for your injuries.

Estate planning gives you peace of mind that your assets are distributed in accordance with your wishes and minimizes the potential for disputes as well as tax implications.

The reason an estate plan is so important is that without it, your assets can wind up in legal limbo.

Estate planning is essential to protect your loved ones and their future. In case of an unexpected event, such as sudden death or incapacitation, proper estate planning ensures that your assets and wealth are distributed in accordance with your wishes. Failure to make an estate plan can lead to legal disputes, family conflicts, and can even put your loved ones in a financially unstable position.

Estate planning can also help reduce taxes and probate expenses. Through proper planning, individuals can take advantage of various tax exemptions and deductions, resulting in significant savings. Moreover, a well-thought-out estate plan can minimize or even eliminate the need for probate, which is a costly and time-consuming legal process.

Estate planning also provides individuals with control over their assets during their lifetime and after death. By creating a will or trust, individuals can designate who they want to receive their assets and in what proportion. Also, through a living will or power of attorney, individuals can appoint a trusted person to make medical and financial decisions on their behalf in case of incapacity.

Estate planning provides peace of mind, knowing that your loved ones and assets are well protected and that your wishes will be carried out even when you are no longer around.

If you’re looking for a trusted partner to assist you with your estate planning, let us guide you toward a secure future.

Your schedule is full. As a business owner, wife, and mother, I fully understand the multifaceted responsibilities you face.

The daily challenges may often seem overwhelming and it's understandable that some tasks get pushed to the bottom of your to-do list.

Essential documents such as your:

must all be completed on time.

These essential documents provide the means to ensure your wishes regarding asset distribution, care for children, end-of-life decisions, and financial matters are respected and fulfilled.

👉Moreover, they offer a clear pathway for your loved ones, sparing them the stress of uncertainty in difficult times.

The consequences of procrastination in estate planning could be far-reaching, but with professional guidance, you can timely address these critical issues.

Don't let estate planning be a task for 'later' - the right time to act is now.

I know just as well as anyone that when juggling the many balls of parenthood and entrepreneurship, it can be all too easy to let some tasks drop. Estate planning, though, shouldn't be one of them. From determining who looks after your kids, to deciding who takes care of Fido and Fluffy, your Last Will and Testament is the linchpin that holds your personal affairs together. A Living Will provides clear instructions for your end-of-life care, while Trusts and Power of Attorney (POAs) offer a safety net for your financial and medical concerns. And let's not forget Life Insurance and Beneficiary Forms - they're not just about leaving a financial legacy, they can also save your family from a legal labyrinth during a stressful time.

Let’s say, for instance, you are a successful entrepreneur with three young kids. You think that you have plenty of time for estate planning. Then you are dealt with an unexpected blow - a health scare. You are dealing with this, the impact it has on your family, and your professional life and now you realize you don’t have your affairs in order. Estate planning isn't something to be pushed off for a 'later' that might never come.

Trust me, you don't want to wait until the eleventh hour to tackle this. The best time to start is now, because when it comes to estate planning, waiting often means it's too late!

Essential Estate Planning Documents:

✔️ Last Will and Testament: Detail how possessions are distributed and who cares for children, dependents, and pets.

✔️ Living Will: Direct end-of-life treatment, including decisions on life support removal.

✔️ Trust: Entrust property or assets to a designated trustee for the benefit of a third party.

✔️ Medical Power of Attorney (POA): Appoint someone to make medical decisions on your behalf.

✔️ Financial POA: Grant someone the authority to handle financial matters.

✔️ Life Insurance: Provide financial support for loved ones, cover expenses, and leave a legacy.

✔️ Beneficiary Forms: Name beneficiaries to bypass probate and ensure assets are directly received.

🚦Did you know that there are some instances in which the pedestrian can be at fault for being hit by a car? Yes! Know the rules and how breaking them can impact your case. 🚸

We all know the insurance adjustor will scrutinize the facts of your case because they are looking for evidence that you are at fault. They will review evidence such as statements from witnesses, photographs of the intersection, traffic signals, and so on.

Here are some situations where a pedestrian might be considered responsible if they get hit by a car:

1️⃣ Jaywalking: If you cross the road in front of an oncoming vehicle while the driver has the right of way, and get hit, you bear some responsibility for that. This is especially common in bustling city intersections. The person in front of you is crossing, why can’t you follow along? Don’t do it! It’s better to walk a few feet further and cross at a designated crosswalk!

2️⃣ Restricted Roadways: Strolling on roads where pedestrians aren't allowed? It could be your fault if an accident occurs. Make sure to stay off of roads where pedestrians are not permitted. It could lead to a dangerous situation for you and any drivers in the area.

3️⃣ Against the Signal: Crossed the road on a crosswalk when the signal said no? You're in the wrong. This could lead to a potential disaster as our brains are conditioned to watch for a signal and drivers will not be expecting a pedestrian to be walking across the road.

4️⃣ Obstructive View: Moving across a road with poor visibility? Your risky move could make you liable!

5️⃣ Impaired Walking: Distracted by your phone, intoxicated, or under influence of drugs? If an accident happens, you might be held accountable.

Post-accident, insurance companies will scrutinize the facts. If they find the pedestrian at fault, they could deny the claim. Even more surprising, if the driver gets injured due to a pedestrian's negligence, they could receive damages for the accident.

Stay safe out there! 🚶‍♀️🚶‍♂️🚗
