So many people think that hiring a lawyer is only for when you are going to file a lawsuit.

Does that mean I file lawsuits?
👉 Sometimes.

But only when settlement negotiations have failed. And only when my client and I have had a full conversation about whether litigation is advisable.

The reality is that the majority of the time a lawsuit is not necessary.

🧐 So what do I do for my clients?

⭐️ Identify all the sources of insurance coverage for them. It's not just the auto liability policy for the at-fault driver.

⭐️ Communicate with the insurance companies on their behalf so they can focus on healing. Insurance adjusters know how to put the pressure on to settle quickly with folks who don't have legal representation. But, when the injured person has an attorney, the insurance company is only allowed to contact the attorney; so, the injured person doesn't have to feel dread or stress when they see the insurance company's name on their caller I.D.

⭐️ Take the stress out of navigating and negotiating their claim. I educate and inform my clients about their claim, what is considered in determining claim value, the strengths and weaknesses of their specific claim, and their role in negotiations.

⭐️ Investigate and determine the validity of any claim for reimbursement that a health insurance carrier might make. There are certain circumstances wherein a health insurance carrier has a legal right to be reimbursed when the personal injury claim is resolved. I educate and inform my clients about these considerations and force the health insurance carrier to produce proof of their qualifications for reimbursement.

1️⃣ Wear a seatbelt. Using safety restraints can significantly reduce your risk of injury if an accident does occur.
2️⃣ Put the phone away. No one should be using their cell phone while driving. In fact, it’s against the law in Virginia for a driver to be holding a cell phone!
3️⃣ Don’t speed or run yellow lights. Speed is a factor in a large percentage of vehicle crashes.
4️⃣ Don’t drink alcohol or use drugs (including prescription) and drive

Following these tips will reduce some of the greatest risk factors that lead to a serious or fatal crash.

9/11/01 - I lived in an apartment building located outside the gates of Henderson Hall, a Marine base, and next door to the Navy Annex in Arlington, VA. 800 yards down the street was the Pentagon.

I had a court hearing in Alexandria that morning. After the hearing, I stopped in a shop on the way back to the car. The salesman was listening to the radio. The radio announcer was talking about people jumping out of windows in New York.

I got in the car and drove up the GW Parkway, heading home. I came around a bend in the road and suddenly there was smoke in the air over the Pentagon.

My heart dropped. We were clearly under attack.

Traffic was at a standstill. I had to leave my car in Crystal City and walk the rest of the way home. Cell phones weren’t working. Marines with machine guns were posted around the perimeter of the Pentagon and outside the Marine base. The air was full of smoke and the Pentagon was on fire.

The plane had streaked right over my apartment on its final descent into the Pentagon. Sandra Teague was on that plane. We learned Sandra’s fate while her boyfriend watched tv with us in our living room that day.

Frank had dropped Sandra at Dulles that morning for the first leg of her dream vacation to Australia. I struggle to think of how panicked and terrified she must have been on that plane.

I remember how numb, shocked, and terrorized we felt. I remember watching tv footage on repeat all day showing the jet hitting the South tower. I remember wanting to do something. Anything. But there was nothing to do except sit on the couch watching the news unfold with the Pentagon burning down the street.

You should always pursue a personal injury case as soon as possible as you only have a limited amount of time available to do so.

In Virginia, the BASIC statute of limitations on personal injury claims is two years from the date of the accident. (** There’s always exceptions and considerations that might alter this, like if your claim is against a governmental entity or if the injured party is a minor.)

The Statute of Limitations is the deadline for when a person must file a lawsuit in order to preserve their rights to make a financial recovery. So, if the claim has not been settled and a lawsuit has not been filed by that deadline, then the injured person’s rights to make a claim ARE FOREVER EXTINGUISHED.

As we approach the beginning of the school season, here’s your reminder to pay attention to school buses and to watch out for children heading to and from school.

Drivers should plan ahead and leave earlier, so they do not have to rush or be late for work while being considerate of buses on the roads.

🚦Did you know that there are some instances in which the pedestrian can be at fault for being hit by a car? Yes! Know the rules and how breaking them can impact your case. 🚸

We all know the insurance adjustor will scrutinize the facts of your case because they are looking for evidence that you are at fault. They will review evidence such as statements from witnesses, photographs of the intersection, traffic signals, and so on.

Here are some situations where a pedestrian might be considered responsible if they get hit by a car:

1️⃣ Jaywalking: If you cross the road in front of an oncoming vehicle while the driver has the right of way, and get hit, you bear some responsibility for that. This is especially common in bustling city intersections. The person in front of you is crossing, why can’t you follow along? Don’t do it! It’s better to walk a few feet further and cross at a designated crosswalk!

2️⃣ Restricted Roadways: Strolling on roads where pedestrians aren't allowed? It could be your fault if an accident occurs. Make sure to stay off of roads where pedestrians are not permitted. It could lead to a dangerous situation for you and any drivers in the area.

3️⃣ Against the Signal: Crossed the road on a crosswalk when the signal said no? You're in the wrong. This could lead to a potential disaster as our brains are conditioned to watch for a signal and drivers will not be expecting a pedestrian to be walking across the road.

4️⃣ Obstructive View: Moving across a road with poor visibility? Your risky move could make you liable!

5️⃣ Impaired Walking: Distracted by your phone, intoxicated, or under influence of drugs? If an accident happens, you might be held accountable.

Post-accident, insurance companies will scrutinize the facts. If they find the pedestrian at fault, they could deny the claim. Even more surprising, if the driver gets injured due to a pedestrian's negligence, they could receive damages for the accident.
