The United States Supreme Court ruled 6-3 today that existing federal laws bar employers from discriminating against employees based on s*xual orientation, not just gender as was the previous standard. This prohibition against discrimination includes transgender people.

Protected classes under Title VII of the 1964 Civil Rights Act include race, religion, national origin and s*x (gender, gender orientation, and transgender).

Employers that are subject to significant penalties should they be found to allow or engage in discriminatory practices against people based on those listed classes.

“Today, we must decide whether an employer can fire someone simply for being homos*xual or transgender. The answer is clear. An employer who fires an individual for being homos*xual or transgender fires that person for traits or actions it would not have questioned in members of a different s*x. S*x plays a necessary and undisguisable role in the decision, exactly what Title VII forbids,” justice Neil Gorsuch wrote.

The California Supreme Court ordered a shutdown to protect the people who work in the court system and the people who interact there.

The shutdown is initially set for 60 days.

Chief Justice Tani G. Cantil-Sakauye said in her order that court facilities were “ill-equipped to effectively allow the social distancing and other public health requirements.”

LA County Superior Court has also ordered a shutdown. Presiding judge of Los Angeles Superior Court, Kevin C. Brazile, blocked public access to county courthouses except for attorneys, staff, defendants and “authorized persons,” a vague category that includes news reporters. The clerk’s office will still be available to accept filings and assist people by phone or electronically.

There have been numerous orders issued at each of the 58 counties in California. Please check with your attorney if you have an active case. Also, due to the uncertain nature of what is and will be happening, delays are certainly occurring in non-essential cases. Essential cases include most criminal and others that require immediate action like domestic violence restraining orders.

Voting in the United States 🇺🇸 is something that is exercised by the individual citizen, at least 18 years of age.

Many barriers have been removed over the decades and it is up to you to go vote in a primary, caucus, and/or general election.

Today is what is called Super Tuesday when 14 states and one territory hold their primaries: Alabama, American Samoa, Arkansas, California, Colorado, Maine, Massachusetts, Minnesota, North Carolina, Oklahoma, Tennessee, Texas, Utah, Vermont, and Virginia.

Beware filing a defamation lawsuit in states with an anti-SLAPP statute.

Trump filed a suit against The NY Times for publishing an op-Ed they say is false and intended to harm Trump, resulting in harm.

These are extremely difficult to win, especially when the article in question is an Opinion Editorial (op-ed). The plaintiff has the burden to demonstrate the defendant knew the statement was false or recklessly disregarded the truth (a very high hurdle).

The landmark ruling that sets the high bar for defamation involving a public figure is New York Times Co. v. Sullivan, 376 U.S. 254 (1964).

Interesting note: that 1964 ruling involved the racist police commissioner in Montgomery, Alabama and his abuse of civil rights activists.
