The Land Department recently amended the rules for foreign ownership of land in Thailand.

Inheritance: Non-Thai nationals who are lawful heirs of foreigners licensed to own land are eligible to inherit the property.

However, such inheritance must follow the regulations established in land-holding laws or foreigner land ownership standards.

For example, heirs can inherit up to 1 rai (0.160 hectares) of land for industrial use or up to 10 rai (1.60 hectares) for agricultural usage. The use of the land must also be consistent with the authorization granted to the original owners.

Land Purchase: According to Article 96 of the Land Code, foreigners are entitled to purchase 1 rai of land for residential construction with a minimum investment of 40 million baht in the country.

This investment must contribute to Thailand's economic and social welfare or fit under the categories approved by the Board of Investment.

The investments must last at least three years, and the residential property purchased by foreigners must be located in Bangkok, Pattaya, or any other municipality.

Land Transfer: Foreigners can complete land transfer procedures in compliance with applicable legislation, such as the Investment Promotion Act of 1977.

FOREIGN-SOURCED INCOME. Thailand's Department of Revenue issued Departmental Instruction No. Paw. 161/2566 (2024) (DI. Paw. 161), which impacts the tax of foreign-sourced income for Thai residents. The change is that Thai residents are now subject to personal income tax on foreign-sourced income brought into Thailand, regardless of the tax year it was earned. This applies to income derived from employment, business activities, or property overseas.

Previously, foreign income was taxed only if brought into Thailand within the same tax year it was earned. This eliminates that loophole and applies to all foreign-sourced income brought into Thailand from January 1, 2024.

The Revenue Department is preparing to amend a law to collect taxes from individuals who have income from abroad, even if that income is not brought into the country.

According to Kulaya Tantitemit, director-general of the department, the current tax law calls for individuals who reside in Thailand for more than 180 days per year to pay taxes to Thailand if they have income from abroad. If that income is brought into the country, it is subject to personal income tax payments to the department.

However, she said the Revenue Department is amending the law using the principle of worldwide income, whereby taxation is based on the residency of the individual in that country, regardless of whether the income is from domestic or foreign sources.

Ms Kulaya said the department plans to expand the tax base by requiring platforms with an income of 1 billion baht or more to report their sources of income.
