A lady had lodged complaint against a person alleging that he r***d her by threatening her. High Court affirmed the conviction and sentenced him to undergo imprisonment for seven years. Further, in the Supreme Court the bench set aside these concurrent convictions by the following reasons:
• The complainant was not examined by the doctors after the alleged incident.
• Similar types of complaints were being made in the past by complainant against other persons also, later found false.
• There was no eye witness to the alleged incident.
