What is a latent defect and can a seller legally hide it?
A latent defect is a hidden flaw in a property that isnβt easily spotted during a normal walkthrough (like a concealed leak behind the drywall). If a seller willfully hides a defect that impacts the home's value or safety, they can be held legally liable.
Pro tip: Look closely at fresh, isolated repairs. A single piece of brand-new drywall in a 15-year-old basement is a major red flag that a recent issue was covered up.

Do freehold home buyers get a cooling-off period?
Unlike new-build condos which have a mandatory 10-day cooling-off period by law, freehold buyers don't get one automatically.
If you want a safety net to review documents or secure financing, you have to explicitly write a conditional period into your offer.
If a buyer changes their mind and walks away from a deal, does the seller automatically get to keep the deposit?
The short answer is yes, the deposit is technically forfeited to the seller, but itβs not always that simple. Taking the funds immediately usually requires both parties to sign a mutual release, which could legally waive the seller's right to pursue further damages if the house sells for less later on.
