๐ฃ Yesterday at the National Press Club, Minister Mark Butler confirmed the next phase of NDIS reform. Mandatory registration is expanding, and a lot of providers will feel it.
๐ Whatโs Happening
โ๏ธ Mandatory registration for SIL Providers and Platform Providers starts from 1 July 2026. Every SIL provider will need to be registered.
โ๏ธ Mandatory registration is expanding into personal care, daily living supports, and supports delivered in closed settings.
โ๏ธ Practice Standards remain the benchmark. Auditors and NDIA will want proof.
โ๏ธ Enforcement is sharper. Faster sanctions, banning orders, and compliance notices.
โ๏ธ NDIA is channelling more payments toward registered providers.
๐ What This Means for You
โ๏ธ Technically, registration is still a choice for many providers.
โ ๏ธ But if you deliver personal care, daily living supports, SIL, or any support in a closed setting, that choice is narrowing fast.
๐ What To Do Now
โ๏ธ Check which of your services fall under the expanded mandatory registration categories.
โ๏ธ Compare your systems, policies, and records against the Practice Standards to identify gaps.
โ๏ธ Fix those gaps now, before the rush starts.
โ๏ธ Start your NDIS registration process early to avoid delays.
๐ค Need Help?
โ๏ธ If these reforms affect your business, the worst move is waiting.
โ๏ธ The earlier you act, the more time you have to prepare properly and avoid costly delays.
โ๏ธ We can help you navigate the registration process with confidence.

๐ก๏ธ NDIS Practice Standards reform โ whatโs changing and why? ๐ก๏ธ
If youโre a registered provider, the NDIS Practice Standards set the benchmark for quality, safety and participant-centred supports. ๐ค
Now, that benchmark is being strengthened. ๐ง๐
The NDIS Commission is progressing two major reforms:
๐ New Supported Independent Living (SIL) Practice Standards
๐ A broader NDIS Practice Standards Review
These reforms build on recommendations and insights from:
๐งพ The Disability Royal Commission
๐ The NDIS Review
๐ฃ๏ธ Sector consultations and Own Motion Inquiries into Supported Accommodation
This isnโt surface-level change. Itโs about tightening expectations around risk, governance, frontline capability and participant voice โ especially in higher-risk settings. ๐ก๏ธ
What this means for providers ๐
โ Stronger focus on participant-centred evidence
โ Clearer guidance for workers
โ More targeted, risk-based compliance
โ Greater scrutiny of how systems operate in practice (not just what your policies say)
If youโre planning to register โ or expand into Supported Independent Living (SIL) โ alignment with the current NDIs Practice Standards is critical.
๐ Want to start your registration journey and ensure your application is aligned with the current NDIS Practice Standards?

๐ก NDIS Suitability Assessment: What Providers Really Get Assessed On ๐
Before youโre approved (or renewed), the NDIS Commission runs a formal Suitability Assessment on:
๐ข your organisation + ๐ฅ your key personnel.
๐ What is the NDIS Suitability Assessment?
Itโs a mandatory check used by the NDIS Commission to decide whether your organisation and your key personnel are fit to deliver NDIS supports and services. It applies to new registrations and renewals, and itโs assessed case-by-case using what you submit in the application.
๐ฅ Who Gets Assessed?
Two groups:
๐ข The Provider (your business)
AND
๐ฅ Key Personnel (this includes directors, CEOs, managers, board members, and anyone in senior operational roles).
๐ข Provider Suitability: What They Check
This is the โbusiness risk profileโ scan:
โ Past banning orders
โ๏ธ Criminal convictions
๐ธ Insolvency history
๐๏ธ Regulatory action (ASIC, ACCC, ACNC, AUSTRAC, WHS, etc.)
๐จ Fraud, dishonesty, or misrepresentation findings
๐ Disqualification from managing corporations
Plus: any other matter the NDIS Commissioner considers relevant.
๐ Key Personnel Suitability
Each director or senior person is also reviewed for:
๐ซ Banning orders
โ๏ธ Indictable offences
๐ธ Insolvency
๐๏ธ Regulator action
๐จ Fraud/dishonesty
๐ Corporate disqualification

๐ฉ The emails we love receiving mostโฆ
This is why we do what we do ๐๐ฉ
These are the emails that land after the hard part is DONE.
โ
โWe passed our audit!โ
โ
โNDIS registration approved!โ
โ
โThank you for guiding us through it.โ
And yepโฆ our team celebrates every single one. ๐ฅณ๐พ๐
Because we KNOW what it takes to get there.
What we do differently (so you get the โPASSEDโ email too)
๐ A clear plan from day one (so you always know whatโs next)
๐ Gap check before the audit (fix issues early, not under pressure)
๐ Evidence mapped to requirements (so nothing gets questioned)
๐ Support right up to audit day (youโre not doing it alone)
๐ Fast action on findings (quick, clean close-out)
โ
Behind each email was real work: closing gaps early, getting documents audit-ready, aligning evidence to every requirement, preparing teams for auditor questions, and supporting right through to the outcome.
โจ If youโre working towards audit success or registration this year, you donโt have to figure it out alone.

๐จ NDIS provider compliance crackdowns are ramping up โ and the Annual Report backs it up.
The NDIS Commission has released its Annual Report 2024โ25 ๐
In short: ๐ Compliance + enforcement outcomes are up 214% year-on-year.
Thatโs a major uplift โ and a clear signal the Commission is lifting the bar on provider accountability ๐ฆ
๐ More regulatory action across the board
You can see the stronger stance reflected in:
๐ซ More banning orders (removing providers who pose risk)
๐งพ More compliance notices (non-compliance is being addressed faster)
๐ธ More civil penalty actions (serious consequences where standards arenโt met)
๐ฏ Clearer focus on protecting participants at greatest risk
This yearโs results point to a sharper emphasis on prevention, oversight, and early intervention โ not just responding after harm occurs ๐ก๏ธ
โ
What it means for providers
More scrutiny + more action = the expectation is shifting from:
๐ โWe have policiesโ โ ๐งพ โWe can prove theyโre working in practiceโ
If youโre reviewing your compliance approach this year, make sure your evidence matches your intentions ๐๐
Because the gap between:
โ
โWeโre compliantโ
and
๐ โWe can prove itโ
โฆis where most enforcement action begins.
๐ Want a clear view of where youโre exposed (and how to fix it)?
DM us โCOMPLIANCEโ ๐ฉ and weโll walk you through what ongoing compliance actually looks like โ
๐จWhat is the NDIS Commissionโs Regulatory Reform Roadmap (and what should providers do now)?
The NDIS Commission released a Regulatory Reform Roadmap (Feb 2026) showing whatโs planned over the next 12 months to lift quality, safety and integrity across the sector.
Here are the big 4 areas to watch:
โ
Mandatory registration (starting with SIL services + Platform Providers)
โ
New SIL Practice Standards (with an evidence guide being tested)
โ
Review of Practice Standards (consultation feedback is being reviewed)
โ
NDIS Act + Rules changes (Integrity & Safeguarding Bill is being considered)
๐ The pathway document shows 1 July 2026 as the targeted โgo-liveโ point (noting transition arrangements).
Also note: if youโre currently delivering SIL services unregistered, you may not have to be registered on 1 July 2026 โ but you will need to take action during the transition period to stay in the market.

๐จ Largest penalty ever for an NDIS provider (Tasmania): $1.1 MILLION ๐จ
The NDIS Commission confirmed the Federal Court has imposed a record $1.1M penalty on Oak Tasmania for serious safety failures and systemic incident reporting breaches.
This is the biggest penalty ever imposed on a Tasmanian NDIS provider.
Hereโs what actually triggered the penalty ๐
๐ What the Court found
โข Care plans not followed
โข Staff not adequately trained
โข Medication and medical devices mismanaged
โข 474 serious incidents not reported within required timeframes
๐ The judgment was blunt:
Late reporting deprived the regulator of timely information and compromised participant safety.
The cost
๐ธ $750,000 โ breaches of the NDIS Code of Conduct & Practice Standards
๐ธ $350,000 โ failures under the Reportable Incident Rules
๐ธ $200,000 โ legal costs
๐ Total: $1.3M+ impact
๐ The real lesson for providers
This wasnโt one bad incident.
It was a broken incident management system.
โ ๏ธ Common risk gaps auditors see:
โข Staff unsure what counts as a reportable incident
โข No clear escalation process
โข Incident logs not reconciled with reports
โข Leaders assuming โsomeone else handled itโ
โ
What actually protects providers
A built-right incident management system that:
โข Flags reportable incidents instantly
โข Forces timeframes (no guesswork)
โข Documents decisions, actions, and follow-up
โข Creates an audit-ready trail before the regulator asks
๐ฉ DM us and weโll guide you through setting up an incident management system that captures, triages, escalates, and reports on time.

If youโre applying for NDIS registration โ or already registered โ this one matters.
The NDIS Commission has clarified its expectations under the NDIS (Practice Standards โ Worker Screening) Rules 2018 (effective from 31 March 2025).
Hereโs what auditors will now expect to see ๐
๐ ๐๐ก๐๐ญโ๐ฌ ๐ง๐จ๐ฐ ๐ซ๐๐ช๐ฎ๐ข๐ซ๐๐
All new NDIS applicants must ensure every worker in a risk-assessed role holds a valid NDIS Worker Screening Clearance.
Risk-assessed roles include:
โข Workers delivering NDIS supports
โข Staff or key personnel with more than incidental contact with people with disability (contact includes physical, face-to-face, phone, written, or electronic communication)
Auditors must issue a non-conformity if:
โ Any risk-assessed worker lacks a valid clearance
โ You canโt show how worker screening is monitored or managed
Youโll need to demonstrate that you:
โ Understand what a risk-assessed role is
โ Have workers linked in the Worker Screening Database
โ Track clearance status and expiry dates
โ Act immediately if a clearance is suspended or revoked
โ ๏ธ ๐๐ก๐ฒ ๐ญ๐ก๐ข๐ฌ ๐ฆ๐๐ญ๐ญ๐๐ซ๐ฌ
Worker Screening is now a high-risk audit focus area.
Get this wrong and your registration โ or renewal โ can stall fast.
More regulatory changes are expected in 2026, impacting both new and existing NDIS providers.
