They then got his vehicle and went to get money from a lender amounting to K60, 000 using the same vehicle of the student they killed and placed it as collateral.

PRETORIA’S COURTROOM DRAMA: ZAMBIA’S FIVE-MINUTE COFFEE BREAK vs. A WIDOW'S DIGNITY
Today’s hearing in the South African High Court was less of a legal duel and more of a mismatched sparring match — Advocate Tembeka Ngcukaitobi delivering a courtroom masterclass, while the Zambian government stumbled in with a five-minute cameo that looked more like a tea break than a defense.
On one side: logic, law, and lived reality.
On the other: assertions, fantasies, and the audacity to resurrect presidential benefits for a co**se.
1. The Widow vs. The Republic
Ngcukaitobi drove home what should be obvious in both law and humanity: a co**se has no rights. Once life ends, rights end. Benefits of office don’t travel in coffins — they belong to the living, to the widow.
Yet the Zambian government’s position sounds like a theological seminar in reverse resurrection: trying to reinstate state benefits not for the widow, but for the deceased. As the advocate aptly put it:
> “You cannot reinstate benefits on a co**se. That is fantasy.”
And what a fantasy it is: a government fighting harder for a dead man’s “entitlements” than for the dignity of the widow left behind.
2. Law of the Land vs. Law of Pretence
Pretoria’s court isn’t a Lusaka township square. Lex loci applies: South African soil, South African law. Yet Zambia’s counsel appeared without evidence, without affidavits, without expert testimony on Zambian law — just waving hands and hoping sovereignty could cross borders on a diplomatic passport.
But in court, assertion is not law. The government’s arguments carried all the weight of a WhatsApp forward: loud, dramatic, and legally useless.
3. The Kaunda Ghost
The Kaunda precedent was wheeled out like a tired horse. But as Ngcukaitobi reminded the court: KK died while enjoying his presidential benefits. Lungu, by contrast, had those benefits stripped before death.
