Most buyers treat a deposit as a show of good faith. The law treats it very differently. When a sale collapses because of a buyer's breach, that deposit may be lost entirely.

The Conventional Penalties Act offers limited relief, but the threshold for court intervention is high. A recent case, in which the buyer lost the full R1.725 million deposit, illustrates just how high that threshold can be.

A common sense principle inherited from early Roman law is that the buyer of an item discovering a latent (hidden) defect in it after the sale has a choice of remedies: either cancel the sale and return the item to the seller for a full refund under the actio redhibitoria (“action for returning the thing sold”), or keep the item and claim a reduction in price under the actio quanti minoris (“action for the lesser amount”).

If you hear lawyers talking learnedly about them as “aedilitian remedies”, that’s because both were originally developed by the curule aediles, the high-ranking Roman magistrates tasked with regulating markets and sales. Back then you would most likely see the actions applied in disputes over the sale of slaves and livestock, but these days immovable properties and high-value movables are more likely to be at stake.

On Friday, 29 May 2026, the GLS team had the privilege of participating in the annual Kaskar Dag, hosted by the Rustenburg Skool vir Buitengewone Onderwys.

Throughout the day, we had the opportunity to partner with some of the school's learners and take part in a variety of fun-filled activities, including the kaskar race, dancing, netball, tug-of-war, and much more.

What made the day truly special was witnessing the enthusiasm, joy, and determination of the children. Their energy was contagious, and it was a privilege to share in such a memorable experience.

A special congratulations to our own Jeanè, who was awarded Best Dancer of the Day! We are also incredibly proud that the GLS team was named Overall Winner — an achievement made even more meaningful as it marks the second consecutive year that we have received this award.

The event continues to grow from strength to strength each year, and we commend the school for the incredible work they do. We wish them every success in the future and look forward to being part of this wonderful event again.
