Most business owners have never read Section 37 of the OHS Act.

Here's why that's a serious problem.

Section 37 is the part of the OHS Act that determines who gets held personally liable when something goes wrong on a non-compliant worksite.

The short version: as a director or senior manager, YOU can be held criminally liable β€” not just fined, but prosecuted β€” if an employee is seriously injured or killed on a site where preventable OHS gaps existed.

"But I didn't know there were gaps."

Section 37 doesn't accept ignorance as a defence. The duty of care is on the employer. Always.

"But we have insurance."

Insurance doesn't cover criminal prosecution. And it doesn't cover DoL fines. Those are personal.

Here's what Section 37 actually means in practice:

Why do some people stay calm and effective in an emergency while others freeze? It is rarely about strength or speed. It is about how quickly they make decisions.

A military strategist named John Boyd studied this question and developed a four-step decision cycle now used by emergency responders, medics and crisis teams worldwide. It is called the OODA loop.

Observe - what is actually happening right now? Not what you assume. What you can see, hear and confirm.
Orient - what does this mean in context? Training and experience turn observation into understanding.
Decide - choose one clear action.
Act - carry it out. Then observe again, because the situation has already changed.

The strength of the loop is its speed. Most people stall on Observe, over-analyse during Orient, or rush to Act and miss something critical. Trained responders move through all four steps in seconds, then repeat, until the situation is stable.

This is the thinking behind DDi's first responder training. Real emergencies - workplace incidents, vehicle accidents, medical events - are not solved by memorised steps alone. They are solved by people who can think clearly under pressure.

Most workplace first aid teaches the standard sequence: Airway, Breathing, Circulation. It works well in a calm environment. It works less well when someone has severe bleeding after a workshop or vehicle accident.

That is why tactical medics use SMARCHE. It places the most life-threatening problems first, because a casualty with uncontrolled bleeding does not have time for anything else.

The priority sequence:

S - Scene safety. Never become the second casualty.
M - Massive haemorrhage. Severe bleeding kills fastest. Control it with direct pressure, wound packing or a tourniquet.
A - Airway. Make sure air can move in and out.
R - Respiration. Confirm the casualty is breathing properly.
C - Circulation. Check pulse, perfusion and signs of shock.
H - Hypothermia. A cold casualty loses the ability to clot. Insulate and keep them warm.
E - Evacuation. Move the casualty to definitive medical care.

The order matters because it forces the responder to deal with the worst problem first. The same logic that keeps soldiers alive applies directly to a serious workplace injury.

Basic first aid keeps a casualty stable until the ambulance arrives. But what happens when the ambulance is thirty, forty, or sixty minutes away?

For remote and high-risk workplaces, that is the reality. Mines, farms, construction sites, security operations and off-grid projects often sit far from emergency services. In those settings, the first responder is the medical care, sometimes for the better part of an hour.

An incident happens on site. Paramedics arrive. The first aider, still full of adrenaline, struggles to explain what happened. Critical information is lost. The patient waits.

There is a better way. Professional responders hand a patient over in under thirty seconds using MIST.

M - Mechanism. What happened? "Fell two metres from a forklift, landed on his right side."
I - Injuries. What can you see? "Right arm deformed, bleeding from the forehead, possible rib injury."
S - Signs. Vital signs and responsiveness. "Conscious but confused, breathing fast, weak pulse."
T - Treatment. What have you done? "Bleeding controlled with direct pressure, kept still, emergency services called six minutes ago."

Four clear statements. The paramedic takes over exactly where the first aider left off.

You have just been appointed as your workplace's SHE Representative. It may have felt like a quiet handover in a meeting. It is, in fact, a legal appointment under the Occupational Health and Safety Act.

There is no need to feel overwhelmed. The role of a Safety, Health and Environment Representative is one of the most valuable compliance positions in any business, once you understand what it actually involves.

Under Section 18 of the OHS Act, a SHE Rep has five defined functions:

1. Review the effectiveness of existing health and safety measures.
2. Identify potential hazards before they become incidents.
3. Investigate incidents that do occur, to find root causes rather than blame.
4. Represent the workforce to the employer on safety matters.
5. Inspect the workplace at agreed intervals.

Notice what is not on that list. A SHE Rep is not personally responsible for every employee's safety - that duty sits with the employer. The SHE Rep is the eyes, the ears and the escalation point.

Why does this matter? SHE Representatives are legally required in workplaces with twenty or more employees, and Department of Employment and Labour inspectors will ask to speak with them. A trained SHE Rep also sees risks that management can miss.
