I've had an appellate procedure blog for years, but today I ended up writing an email to a client explaining how an appeal is different from a trial court proceeding, and so we decided to expand on it for our blog readers as part of our Appeals 101 series.

Appeals 101: What is an Appeal? - The Florida Appellate Procedure Weblog by DPW Legal An appeals court is a reviewing court, and it can only review for “preserved error.” Here's what that means to a potential appellant.

The Florida Supreme Court has amended Rule 1.530 and 12.530 again -- and the change makes things more or less confusing, depending on how you look at it. Check out or blog post for tips on how to ensure preservation.

Supreme Court Again Amends Preservation Requirements of Rehearing Rule - The Florida Appellate Procedure Weblog by DPW Legal Rule 1.530 and 12.530 require rehearing motions to challenge the failure to make required findings of fact -- but how do you navigate the rule to ensure preservation when the findings are in non-final orders?

Just gave a presentation to 50 lawyers about the new Copyright Small Claims process that started taking cases in June. I really enjoyed employing my 19-year-old to gather the data for me to crunch.
A small preview:
317 cases filed so far
56% are filed pro se
146 have been dismissed (mostly because they were not filed correctly)
21 defendants have opted out
And of the 14 cases filed on the first day, 9 have been dismissed, and five are still in play. None have had an answer filed yet (but the first answers will be due in February).

Stay tuned!

Great morning presenting a comprehensive CLE on the new Copyright Small Claims system. Happy to answer questions about this complex “simplified” procedure!
