3M notified EPA that as of October 2023 they would suspend the production and sale of 3M™ LeadCheck™ test kits. In light of this, the following is a review of paint testing requirements in EPA’s lead-based paint renovation, repair, and painting regulation.
Testing for lead-based paint prior to renovation in homes and child-occupied facilities built before 1978 is not required. Firms can assume lead-based paint is present and follow the requirements of the rule. However, a client may wish to have testing performed and if the results indicate that no lead-based paint would be disturbed, the project would be exempt from EPA’s renovation regulation. In such a case, the firm would be required to keep records of that determination for three years.

Any renovation, repair, or painting (RRP) project in a pre-1978 home or building can easily create dangerous lead dust. EPA requires that RRP projects that disturb lead-based paint in homes, child care facilities and preschools built before 1978 be performed by lead-safe certified contractors. Generally, EPA’s Lead RRP rule does not apply to homeowners doing RRP projects in their own homes. However, it does apply if you rent all or part of your home, operate a child care center in your home or if you buy, renovate, and sell homes for profit (i.e., a house flipper).
