Response from the City of Springfield Assistant Law Director regarding scanner traffic record requests. Read to the bottom.
Subject: Public Record Request Response – Springfield, Ohio
Sir/ma’am:
We are writing in response to your public records request dated September 30, 2024, regarding Scanner transcripts/recordings. Your request specifically asked for:
In lieu of the scanners being taken offline for the public, I am requesting all recordings and/or transcripts of all Springfield City Police, Fire and emergency calls and runs, Ohio State Police calls and runs, and subsequent reports arising from all the calls.
Dates are from the date the scanners were taken down until the date of the completion of this request, and continuing daily until the police, fire and OSP department calls and runs are made available to the public on the scanners
After initial request, daily email reports.
RESPONSE:
The requested records or portions of records are exempt from disclosure under Ohio Revised Code 149.43(A). The specific exemptions and their legal justifications are as follows:
Exemption: After a diligent search, no records responsive to your request have been found. Under Ohio Revised Code § 149.43(B)(1), public offices are required to make available only existing records, and there is no obligation to create or compile a record to satisfy a request (State ex rel. Fant v. Enright, 66 Ohio St. 3d 186, 1993). If you believe that specific records do exist that meet the scope of your request, please provide more detailed information.
All scanner traffic is processed through the Clark County Dispatch Center. The Clark County Dispatch Center is not controlled or managed by the City of Springfield. You will need to contact the Clark County Dispatch Center for the requested documents.
This concludes your public record request.
