Material Defects, when to disclose?

Virginia is a buyer beware state. In most residential transactions, sellers are not required to complete a lengthy disclosure form listing every defect in the home that they would in many other states, instead Virginia’s Residential Property Disclosure Act, largely tells buyers to conduct their own due diligence and inspections, however…

A seller cannot knowingly:
📝lie about unknown condition
📝intentionally conceal unknown material defect
📝commit fraud or misrepresentation
📝answer a direct question falsely

When thinking about material defects ask questions such as:

🤔was there a problem was it repaired?
☁️Is it still a problem?
🕵️‍♀️Is there evidence of ongoing issues
🫆would a reasonable buyer consider the information important

I tell homeowners to keep records of contractor invoices, permits, engineering, reports, warranty, documentations, and photos of the repairs if questions arise during a sale documentation is your best friend!! A lot of homeowners think that once a problem is fixed, it never has to be discussed again and that’s not always true. When in doubt, please reach out! 😊

One of my biggest recommendations to buyers, especially if you’re relocating or unsure where you want to plant roots, is to spend time exploring the communities themselves before making a decision.

This past Memorial Day weekend I explored Middleburg, Virginia , Wi******er, Virginia, Vienna, Virginia , and every single area had a completely different personality and lifestyle vibe.

Middleburg brought boutique shops, coffee spots, antiques, and a slower historic charm. Wi******er felt more relaxed and family-oriented with local eateries, walkability, and community gathering spaces. Then Viva! Vienna! showcased just how strong and connected a community can feel through volunteers, local businesses, youth programs, performances, and community organizations.

As a Realtor, I always encourage clients to think beyond the house itself. The community around you matters just as much as what’s inside the walls, especially when considering long-term lifestyle goals, family needs, commute preferences, social opportunities, or even investment potential.

The right home should align with the way you actually want to live.

There’s something special about local community staples.

We kept hearing about the cinnamon sourdough loaf from Great Harvest Bread Co. at the Brambleton Farmers Market… but every single time we went, they were SOLD OUT. 😅

After more than a week of trying both the Herndon location and the market, we finally got our hands on one. And honestly? It lived up to the hype.

So naturally… we decided to try making our own at home.

One loaf is already gone, so I’d say the family approved. 😂

Funny enough, this is a lot like real estate and community building. Sometimes the best things take persistence, timing, trial and error, and a willingness to learn from others around you. The local spots, traditions, small businesses, and experiences are part of what truly makes a neighborhood feel like home.

That’s one of the reasons I love Northern Virginia communities so much, there’s always something new to discover, support, and share with family and friends. ✌️

And just like a good sourdough recipe… real estate is all about the right ingredients, patience, and knowing when the timing is right.

Exploring the new Capital One playground area today, and this is exactly the kind of space I point out to clients when we talk about lifestyle — not just homes.

Free parking for the first two hours under the pickleball courts, walkable from the metro, and thoughtfully designed play areas for kids of all ages. It’s an easy place to gather, connect, and enjoy time together. Wegmans across the street doesn’t hurt either.
