Every new hire, no exceptions: Form I-9 has to be fully completed within 3 business days of their start date. Miss that window and you’re not just behind on paperwork, you’re out of compliance with federal law, and it’s one of the easiest things for an auditor to catch.
Quick breakdown:
Section 1 (the employee’s part) is due by day one.
Section 2 (your review of their ID documents) is due by day three.
No I-9 on file, or a late one, can mean real fines even if everything else about the hire was clean.

One of the biggest HR misconceptions is:
“They’re salaried, so they don’t get overtime.”

Being paid a salary does not automatically make an employee exempt from overtime.
To qualify as exempt, an employee generally must meet specific requirements related to:
✔️ Salady basis
✔️ Salary level
✔️ Job duties
Those requirements can vary depending on applicable federal and state laws.
Why it matters: Misclassifying an employee as exempt can lead to unpaid overtime, back wages, penalties, and other costly consequences for a business.
