I lost the race, so they are coming for my law license...

Because so much of what I said hit home at the courthouse, the local judges have started a non-discipilinary case against me to take my law license.

Rutherford County judges are claiming I am not able to practice law because I am disabled (100 percent military service-connected).

Standing up for clients, for the community, and for Justice, there is no room for that in Rutherford County...and you must be disabled if that is your idea of representing clients.

Trial judges work an average of 2.7 hours a day! Where does the other 5.3 hours go? My opponent blamed the DA for failing to schedule full criminal court dockets. She then blamed the chief district court judge for her lack of a civil workload. Attached are a few of his days in court too…both he and the DA are supporting my opponent! They are circling the wagons right in your face!

Final post regarding dockets, here are the civil dockets from McDowell County Clerk of Court’s Office. I reviewed three binders worth of civil dockets, attached are pictures of the docket minutes from my opponent’s days.

Days of court dockets attached: 41 days
Number of hours “on the record”: 113.5 hours (14.2 days)
Average number of hours worked per day: 2.7 hours
At 8-hour work days, the judges worked 14.2 days and had 27 days worth of hours off the bench. Nearly double their trial time was spent off the bench v. On the bench!

— “On the record” is reflected when the recording device is on and recording.
— I did not review the criminal dockets in McDowell, the Clerk’s record does not contain the start and/or stop times and therefore they would not serve a purpose.

Saying you have an AM and a PM docket is like saying you go back to work after lunch…I thought everyone understood a workday is typically 8-hours, then I meet my opponent.

Don’t believe the misleading claims about working “eight DSS dockets in a month”; with two counties having an AM and a PM docket on the 3 or 4 days a month DSS court is held, calling it an AM and PM docket still just means one calendar day a week for DSS court.

I have posted many criminal dockets to show the typical work schedule of my opponent when she is assigned to criminal court. This post has civil dockets and highlights when court started and stopped each day she was on the bench in a civil court session. Note, most family court orders are drafted by the attorney that wins the case, not the judge.

Just seems like a judge making over $120,000 of your tax dollars should work a little more to earn it…the time on the docket shows when court started and stopped each day my opponent was on the bench.

District Court judges are trial judges. They need to be on the bench, not working half days. These dockets are from criminal court. Note that judges do not draft and write orders for criminal cases, they simply sign form orders. My opponent will claim 1) she is on call 24-hours a day and/or 2) she does not control the docket, the DA does.

FACT CHECK: Both claims are misleading. Being called after hours as a district court judge is rare and we have four judges - NOT all of the judges are on call at the same time.

Further, the judge controls when cases are continued once they are on the docket. If there are 100 cases already scheduled for a day, then don’t allow the next case to be continued to that day. Somehow, that logic is lost on my opponent.

I will work and not allow the DA to overcrowd the docket to the point the only option we have is to continue most cases.

ZERO TRIALS WERE HELD DURING THE DAY DESIGNATED FOR TRIALS

“ACH sessions” are referred to as “Anything Can Happen” court

Civil ACH sessions were allegedly designed to deal with cases that require an actual trial (most cases are resolved without a trial). As you can see, it is nothing more than another day to continue cases.

Leaders don’t run in packs!!

It’s no wonder these two are campaigning together. My opponent has stated she can only handle what the DA has put before her. In reality, she could add civil cases to her open afternoons rather than leaving for the day.
