It’s a busy day for NVAC in the courts!
Following Judge DuBose’s order earlier today, the First Circuit Court of Appeals just DENIED VA’s emergency motion to stay pending appeal. The First Circuit denied that motion “without prejudice,” meaning VA may refile its motion consistent with appellate court rules. NVAC will then have an opportunity to file an opposition and argue why Judge DuBose’s preliminary injunction must remain in place during the appeal process.

GRANTED: NVAC’s Motion to Enforce Preliminary Injunction was granted this morning in the U.S. District Court for the District of Rhode Island.
Today’s hearing confirmed that despite the VA’s unlawful actions, collective bargaining must be reinstated. The VA must comply.
During the hearing for our motion to enforce the preliminary injunction, Judge DuBose gave the VA until Tuesday to explain how its actions could be interpreted as anything other than contempt of court. Their refusal to implement the Court's order and their illegal re-termination of the contract are blatant disrespect not only for the Court's order but also for the law.
The National VA Council extends our deepest gratitude to all our members and leaders who provided evidence of the VA’s non-compliance. Those who have stayed with and joined our union are the reason we continue to win victories like today.
