It has long been Kevin Jacoby's opinion that the advertising restrictions applicable to Oregon’s cannabis advertising market were unconstitutional.
⚠️ On October 16, 2024, the Oregon Court of Appeals issued a decision in Bates v. Oregon Health Authority holding that a similarly-worded statute prohibiting packaging and labeling of ni****ne v**e products “in a manner that is attractive to minors” violates Article I, section 8, of the Oregon Constitution.

Next week Mike Getlin, Board Chair of Cannabis Industry Alliance of Oregon, will share his insight as an industry stakeholder regarding the Aspergillus lawsuit against Oregon’s unfair testing policies. Allow us to share his background in the cannabis space:
📍Raised in rural Clackamas County, Mike attended West Linn High School before completing his BA in Government at Harvard. He moved back home with his family and started a small family cannabis farm near Oregon City in 2016. He founded the Oregon Industry Progress Association, a tactical lobbying group focused on nuts-and-bolts rule and statute improvements for the OLCC licensed industry in Oregon.
🏛️ Mike spent years actively lobbying in Salem, and led the merger of the four competing trade associations in Oregon into what became the Cannabis Industry Alliance of Oregon, the largest industry trade association in the Pacific Northwest, for which he now serves as the Board Chair.
🌲Through his tenure in the cannabis public policy space, Mike has played a critical role in each piece of cannabis legislation up for consideration in Oregon over the last six years. He is also the Director of Licensing & Public Affairs for Nectar Markets, a role that has allowed him to focus on utilizing the lessons learned in the Oregon market to consult with legislators and regulators in other states as they wrestle with the complex policy issues surrounding the growing cannabis industry.
