Very pleased with the ruling today where our Supreme Court affirmed Prop 211, the Voters' Right to Know Act.
The portion of the ruling that gives the plaintiffs the opportunity to return to court to show whether any donor was affected does a disservice to the Court and the doctrine of originalism.
First, the Arizona Constitution commanded the first State Legislature to enact disclosure provisions; it is one of the principal reasons that the Arizona Corporation Commission exists today — because Arizonans don't trust big corporations or big money, it is a deeply ingrained characteristic of State 48.
If that weren't enough, we all remember what Justice Scalia wrote in Doe v. Reed, "Requiring people to stand up in public for their political acts fosters civic courage, without which democracy is doomed. For my part, I do not look forward to a society which, thanks to the Supreme Court, campaigns anonymously... This does not resemble the Home of the Brave."
