One of the first things insurance adjusters do after an accident is pull your medical history.
They're looking for a prior back injury, an old surgery, anything they can point to and say: "This wasn't caused by our client — you were already hurt."
But California's eggshell plaintiff doctrine is clear: a defendant takes the victim as they find them. If an accident aggravated, worsened, or accelerated a pre-existing condition, you are entitled to compensation for that impact — even if you weren't starting from perfect health.
