⚖️ Under Wos, a state cannot fix the medical portion of an injury victim’s settlement by statute. Federal law requires a procedure to challenge the default allocation.

🧮 Example math to illustrate the point: A state statute says 40 percent of every PI settlement is allocated to medical care. Your client settles a back injury case for $400,000 with total damages of $2.5 million. Future loss of earning capacity alone exceeded $1.2 million. The state demands $160,000 reimbursement.

❌ That fixed presumption is the kind of formula Wos preempted. A court allocation, a jury verdict, or a binding stipulation binds the state under federal law.

⚖️ In 2013, the United States Supreme Court reviewed North Carolina’s Medicaid statute.

The state took one-third of every personal injury settlement as Medicaid’s reimbursement.

❌ No allocation between medical and non-medical damages.

❌ No procedure for the injury victim to challenge it.

In Wos v. E.M.A., the Court held that approach was preempted by federal law.

The federal anti-lien statute at 42 U.S.C. § 1396p protects an injury victim’s property right in the non-medical portion of a settlement.

A state cannot designate that portion as medical by statute without a procedure to challenge it.

An irrebuttable, one-size-fits-all statutory presumption is incompatible with the Medicaid Act’s clear mandate.

In the latest Peak Practice Newsletter, Jason Lazarus breaks down his recent Trial Lawyer View podcast conversation with Nick Norden, founder of Norden Leacox in Orlando, who left the defense side, built a true trial firm, and scaled it to seven attorneys without grinding himself into the ground.

Here is what stands out:
· Your ego is the ceiling. At a Fireproof conference, Mike Morse called Nick and his partner out in front of the room. Both said they were the best trial lawyer at the firm. Mike told them that answer was the problem. If you want to scale, you hire lawyers better than you and step back to run the business. Your skill in the courtroom is the thing keeping you trapped in the work.
· Run it like a business from day one. Nick and his partner wrote a full business plan before opening the doors. Budget, marketing, one-year through ten-year targets. Most lawyers do the opposite and figure out the business side after it breaks. The trap that gets smart lawyers: paralysis by analysis. In business you make the call at 80 percent of the information, then adjust.
· Hire on values, fire fast when fit is wrong. Nick kept a high performer who was a poor cultural fit because they were good at the job. Other people left over it. When he finally made the call, the whole firm changed overnight and people who had quit asked to come back. Now skill does not save anyone who fails the core values.
