Cutts was seeking a sentence modification on both counts that he was convicted of - First-Degree Murder and Armed Burglary with Battery. But the state attorney successfully argued that the review should only apply to one count. The judge agreed and the current review is only for the murder charge.
That means even if Cutts wins his release on the murder count, the armed burglary sentence on count 2 could still keep him incarcerated. However, the Florida Supreme Court currently has a case on its docket that could upend the ruling that a review can only be for one count. So, things are complicated and could change.
Still, after the hearing concluded, the Judge did not rule from the bench. The defense has until June 26 to file a post-hearing memorandum. And then the state has two weeks to respond. We could get a ruling from the Judge on sentence review for the murder charge by mid-July.
