The U.S. Supreme Court just handed down a unanimous 9–0 ruling that ends the federal preemption shield freight brokers have relied on for decades.
In Montgomery v. Caribe Transport II, LLC, the Court made it clear: if you book a carrier with a failing safety record and something goes wrong on the road, you are liable. No more hiding behind federal law.
This is the most significant legal shift the brokerage industry has seen in 30 years. It will separate the brokers who vet with discipline from the ones who just move freight and hope for the best.
