NOT GUILTY
For our client, this verdict means far more than two words.
After facing a charge of First Degree Reckless Injury in Brown County and living under the weight of uncertainty that comes with a serious felony accusation, our client can finally move forward with their life.
Attorney Nicole A. Muller, partner here at Birdsall Muller LLC, successfully defended the case by demonstrating that our client acted in self-defense. After hearing all of the evidence, the jury agreed and returned a verdict of Not Guilty. We are grateful the jury carefully considered the evidence and reached the right result.
Cases like this are a reminder that there is always more to the story than the allegations contained in a criminal complaint and discovery. Our client maintained their innocence, trusted the process, and put their future in our hands.
Today, we are celebrating not a win for our firm, but a win for our client. Someone who can now put this chapter behind them, return to their family, their work, and their future without the burden of a wrongful conviction hanging over their head.
That is why we do the work we do.
This is why we fight and fight to win.

Birdsall Muller LLC is proud to announce that both Attorney John A. Birdsall and Attorney Nicole A. Muller have been recognized by the Wisconsin Association of Criminal Defense Lawyers with two of its most respected honors.
Attorney Birdsall and Attorney Muller have both been awarded the Martin Hanson Advocates Prize and the KNS Sensitive Crimes Award for their outstanding work in complex homicide and s*xual assault cases.
The Martin Hanson Advocates Prize is awarded to practitioners who have accomplished the rare and difficult task of winning a homicide case. While many attorneys take on these serious charges with skill and dedication, this award recognizes the exceptional work required to secure an acquittal, an outcome that reflects outstanding advocacy at the highest level of criminal defense.
The KNS Sensitive Crimes Award, honors criminal defense attorneys who have secured acquittals in felony s*xual assault cases involving either adults or children. These cases demand a unique combination of sensitivity, toughness, deep legal research, and highly skilled trial advocacy. They often require mastery of complex and evolving areas of law, including medical and forensic evidence such as SANE exams and DNA, as well as navigating the challenges of examining vulnerable witnesses and litigating within the constraints of r**e shield laws. In an era where the social and political weight of these allegations is immense, achieving an acquittal represents a rare and remarkable result against significant odds.
These recognitions matter. Not because of the accolades themselves, but because of what they represent: the countless hours, the relentless preparation, and the refusal to back down when everything is on the line for our clients.
At Birdsall Muller LLC, we don’t do this work for recognition, but it is meaningful to be acknowledged by our peers for the intensity and dedication we bring to every case. These awards are a direct testament to our commitment to one thing: winning for our clients.
🚨 Major Criminal Justice Update - Wisconsin just restored its commutation process 🚨
Governor Tony Evers has officially restored Wisconsin’s commutation process, allowing certain incarcerated individuals the opportunity to have their sentences reduced for the first time in decades.
Unlike a pardon — which comes after a sentence is completed — a commutation can shorten a sentence currently being served.
The new process creates a Commutation Advisory Board, establishes eligibility standards, and introduces a separate pathway for youth offenders serving life sentences.
While no single reform solves the challenges facing our system, restoring commutations is a meaningful step in the right direction. So a huge shout out to for taking the first step. You’re one cool dude.
At Birdsall Muller LLC, we remain committed to advocating for our clients at every stage because justice and advocacy do not stop at conviction or sentencing.
🚨 NEW LAW ALERT 🚨
Guess cops didn’t like it when we showed up at their homes…now they know how our clients feel.
Today, signed 33 bills into law. One of them, now 2025 Wisconsin Act 150, impacts criminal defense in that it changed subpoena service requirements.
Specifically, the new law mandates that a subpoena can only be served upon a law enforcement officer, Tribal law enforcement officer, public officer, or public employee at their work address if the testimony is related to events or actions taken in their official capacity or within the scope of their employment.

Some people describe us “street fighters in the courtroom.” And honestly, they are not wrong. However, unlike most street fighters we do come to the fight equipped with an intentional strategy to win.
At Birdsall Muller LLC, we don’t shy away from hard cases, tough opponents, or high-stake trials. We prepare relentlessly, fight strategically, and stand shoulder-to-shoulder with our clients when everything is on the line. We don’t back down when the pressure rises, in fact that’s when we do our best work.
During a recent month-long trial, NBC Dateline producers sat in the courtroom and watched our approach firsthand. After seeing the way we advocate, challenge, and fight for our client, they described us the same way many clients already had:
“Street fighters in the courtroom.”
Because winning is not about theatrics. It’s about commitment, preparation, and the willingness to do what needs to be done.
We take every case personally.
We fight every battle intentionally.
And when our clients need someone in their corner, they know we will go the distance.
It’s simple. We fight to win. Period.

Here’s to the women who lead, who advocate, who challenge the system, and who refuse to accept anything less than progress.
Today is a reminder that the progress women have made was never given freely. It was fought for, earned, and built by women who refused to step aside. And because of them, the world is stronger, fairer, and more just.
At Birdsall Muller LLC, our firm simply would not function without the extraordinary women who show up every day with intelligence, grit, compassion, and relentless dedication to justice. From the attorneys fighting in the courtroom to the staff working tirelessly behind the scenes, their work, talent, and strength drive everything we do.
On International Women’s Day, we celebrate not only the women of our firm, but the achievements of women everywhere. Those who have broken barriers, those who continue to push forward despite obstacles, and those who are building the path for the next generation.
The pursuit of justice requires courage. Today, we honor the women who bring that courage with them every single day.

⚖️ New SCOTUS Decision Alert
The U.S. Supreme Court just clarified an important boundary in criminal trials, and it directly impacts how defense attorneys can communicate with clients during testimony.
In Villarreal v. Texas, the Court held that judges may restrict attorneys from discussing a defendant’s ongoing testimony during a recess without violating the Sixth Amendment right to counsel. The decision draws a constitutional line between protected legal strategy discussions and conversations that could shape testimony mid-trial.
What does this mean for defendants and for trial strategy moving forward?
👉 When a defendant takes the stand, their legal status temporarily shifts from client to witness, allowing courts to limit discussions about testimony itself while still permitting conversations about broader case issues.
Our latest blog breaks down:
✔️ What the Court actually held
✔️ How this changes trial practice
✔️ The real-world impact on criminal defense strategy
✔️ What attorneys and defendants need to understand going forward
