This is the second post on our immigration risk due diligence framework based on our experience reviewing hundreds of EB-5 projects across the country.⠀
The key to this question is job creation. Many projects today determine job creation as a combination of both construction expenditures and operational revenues. The safest projects are those in which the job creation from construction expenditures alone creates several times the required number of jobs per investor. For projects with that reality, the jobs created by operating revenues are not necessary to reach the minimum number of jobs for each investor. To reduce the immigration risk even further, investors should seek projects already well under construction and with very high job cushions.⠀

For a foreign investor considering an investment in an EB-5 regional center sponsored project, two main types of risk must be evaluated: Immigration risk to get the permanent Green Card, and Financial risk to get their $500,000 or $1,000,000 investment back at the end of the investment term, or to get the initial capital contribution back along with any administrative fees as soon as possible in the case of an I-526 denial. The Projects creates Jobs, but how is it calculated? The EB-5 Program was created to encourage economic growth through foreign investment in U.S. businesses, particularly through job creation. The program goals can be summarized into: a capital investment in a new commercial enterprise (NCE) that creates at least 10 full-time, permanent jobs for qualifying employees. ⠀
How these jobs are calculated, however, depends on the manner in which the investment is made and several other factors. Foreign investors may make EB-5 investments directly into an NCE—which allows investors to count only those jobs created directly by the NCE toward job creation (operations jobs generated by the enterprise’s ongoing business)—but most participants choose to invest through regional centers, which allows for a more favorable method of calculating job creation that includes direct, indirect (As the NCE spends money on local goods and services, demand increases and jobs are created.), and induced(induced jobs are created when employees of the NCE spend their wages locally) jobs.The EB5 Affiliate Network developed a Job Calculator totally Free where you can enter the Project details and it calculates Projects potential to create Jobs. @ São Paulo, Brazil
