Co-Managing Partner Aaron Davis was recently featured in the Daily Business Review after the state of Florida filed a civil lawsuit against OpenAI and CEO Sam Altman earlier this week.

The lawsuit is the first state-led action against the company, alleging that the makers of ChatGPT prioritized profit over safe development and continue to advertise the chatbot as a helpful tool for all ages, despite conflicting evidence.

Aaron emphasized that prior research should have been conducted to establish associated dangers before ChatGPT was put on the market.

"If you wanna talk about pharmaceutical drugs or automotive component parts, you don't just release them without doing studies on what the impact of releasing that stuff would be," Aaron said. "But in this world, which is totally new, there's a race to market, and sometimes people that want to be out in front can break stuff along the way."

Bloomberg Law featured Partner Lee Paris for his insights on the growing wave of litigation seeking to hold AI developers accountable when chatbot use is linked to real-world violence.

In the article, Lee examines the legal questions courts now face as they consider when an AI company crosses the line from generating information to encouraging harmful conduct. He also discusses whether developers have a duty to review concerning activity and alert law enforcement.

Lee notes that these cases will test whether companies racing to expand their market share have implemented sufficient safeguards to address the foreseeable risks posed by increasingly powerful generative AI tools.

The Daily Business Review recently featured Davis Goldman Co-Managing Partner Jason Goldman for his insights on the legal and operational challenges tied to Florida’s expansion of mental healthcare services through urgent care centers.

In the article, Jason explains that while these care models can improve access to treatment, they also introduce meaningful liability risks for providers navigating complex and at times subjective screening decisions.

Jason emphasizes that healthcare providers can reduce risk by implementing clear protocols, relying on standardized diagnostic tools, and maintaining thorough documentation.

"We will see some friction here as this becomes a more common feature of our healthcare landscape. I do think that it's still a good thing, I think it should happen," Jason said. "I think it needs to happen with the proper protections, protocols and procedures in place."

Co-Managing Partner Aaron Davis was recently featured in The Daily Business Review for a column he co-authored with Stuart Grossman, co-founder of Grossman Roth Yaffa Cohen, titled “There’s No Algorithm for Human Connection in the Practice of Law.”

In the piece, Aaron and Stuart explain that just as billboards and radio ads do not win trials, technology alone does not either. What ultimately drives results in the courtroom is human connection, judgment, preparation, and credibility.

They emphasize that while AI and emerging technologies can enhance efficiency, the practice of law still depends on something no algorithm can replicate, understanding people.

Co-Managing Partner Jason Goldman recently shared his legal insight with the Florida Record on Florida’s evolving approach to third-party litigation funding (TPLF). As the practice becomes more common, he noted that clear, uniform rules will be essential to protect attorney-client privilege while maintaining transparency in civil litigation.

Jason highlighted how TPLF can “democratize litigation,” giving lower-income plaintiffs a chance to challenge well-funded defendants. He also stressed the importance of clear guardrails as Florida considers future regulations.

While proposed TPLF legislation stalled this session, Jason made it clear in the article that regulation in Florida is only a matter of time. “It’s going to pass in the future at some point,” he said. “Florida is going to lean into this.”
