Lamar Advertising, which about a hundred billboards in Fayette County, Kentucky as well as some in Dane County, Wisconsin, was on the losing end of a federal court decision: Lexington's regulation of billboards does not interfere with the billboard company's first amendment rights:

This is good news for Madison, Fitchburg, and other municipalities that have ordinances regulating billboards.

The Austin, Texas, court decision we previously reported last April 21 has come home to roost in Madison. A 3-judge panel of the federal 7th Circuit Court of Appeals has ruled that Adams Outdoor Advertising cannot sue the city over allegations that its sign code is unconstitutional, relying on the Austin decision. Advertising companies wanted to overturn Austin’s billboard rules. U.S. Supreme Court says no. 04/22/2022

Lamar Advertising, a minor player in the Madison market, was dealt a blow in case that could have wide-spread implications. The U.S. Supreme Court, in a 6-3 ruling, just determined that Austin, Texas regulations of "off-premises" signs were not unconstitutional content-based restrictions on free speech, even though the sign must be read to determine whether it was advertising for an on- or off-premises business. This bodes well for local Madison and Fitchburg regulation of off-premises signs, which basically ban new billboards.
