Oracle is suing Wisconsin’s Public Service Commission in a new fight over who bears the financial risks of powering massive data centers.

The tech giant, which plans a data center in Port Washington, wants to overturn PSC requirements that developers with lower credit ratings provide financial guarantees to protect utility customers from potential cost overruns. Oracle says the rules could force it to post more than $100 million a year in cash deposits or letters of credit.

Ratepayer advocates and clean energy groups are backing the PSC protections, arguing they help ensure existing customers don’t end up footing the bill if a project runs into trouble.
