On camera, the jurors weren't so sure.
Here's what the research says your firm needs to know.

The science cuts both ways.

The Brennan Center for Justice found that face-to-face testimony is perceived as more vivid by jurors, and in turn more credible and more memorable than video-based testimony. That is the silent tax your firm pays every time a witness appears remotely without preparation.

But here is what most partners miss: Harvard Law School professor D. James Greiner and his research team found that jurors cannot reliably detect deception in person either. The problem is not the medium. The problem is a credible witness who looks uncertain on camera because no one trained them for it.

And the rules are tightening fast.

Georgia's Supreme Court enacted new Uniform Superior Court Rule 9.2, effective March 1, 2026, requiring secure attorney-client breakrooms, simultaneous audio and video for all participants, and guaranteed exhibit visibility in all virtual depositions. Vermont's Supreme Court has opened a formal public comment period on statewide technical standards for remote and hybrid proceedings.
