One of the biggest surprises for home sellers in Ohio is learning that your spouse may still need to sign closing documents… even if they were never on the mortgage or deed.

A lot of sellers assume:
“No mortgage responsibility = no involvement in the sale.”

But in Ohio, that’s not always how it works.

Ohio still recognizes something called dower rights, which can affect how a home sale is handled during marriage — even if the property was purchased before the marriage, or held in only one person’s name.

That means situations like these can catch people off guard:

• You owned the home before you got married
• Your spouse was never added to the mortgage
• You’re legally separated but not divorced yet

…and the title company may still require both signatures before the sale can move forward.

These situations are manageable when they’re identified early. The biggest issues usually happen when these conversations are delayed until later in the process — especially when one person is ready to move forward with the sale and the other is not.

A lot of people don’t realize how many details can affect a home sale in Ohio until they’re already in the middle of one.

One thing I’ve noticed over the years is that some of the most difficult real estate decisions aren’t always about pricing or negotiations.

Sometimes people are simply trying to make clear decisions during an already stressful time in their life.
