I believe this is a good move from Gov. Abbott.
In a letter to the Public Utility Commission of Texas (PUCT) and the Electric Reliability Council of Texas (ERCOT), Gov. Greg Abbott called for immediate action that would ensure Texans do not pay the price of connecting data centers to the state’s electric grid.
“The rapid scale of data center development requires oversight to ensure everyday Texans are not burdened with the costs of infrastructure driven by data center expansion, and to ensure that as data centers interconnect to the ERCOT grid, residential electric bills are not negatively affected,” Abbott’s letter read.
The PUC is currently drafting new regulations on how large load customers, like data centers, interconnect to the grid. The new regulations are part of Senate Bill 6 which passed the legislature in 2025. The legislation called for upfront financial investments of large load users that wanted to interconnect with the grid.
Abbott’s letter uses stronger language, directing the agency to “take action to require data centers to pay for all of their electric infrastructure costs to ensure that no residential ratepayer is burdened by those costs.”
Abbott also called on the PUC to ensure that the data centers’ interconnections result in reduced residential electrical bills. Energy generation experts said requiring large load users to pay for upgraded electrical facilities would create a more efficient system that could reduce costs. Experts said the PUC can also reallocate what percentage of transmission costs customers pay, with large load users taking a larger share than what they pay now.
Abbott directed the PUC to initiate action to reduce residential ratepayer transmission costs by July 31, 2026.
He ended the letter with a few priorities he pledged to work on with the legislature in the 90th session starting next January. They include:
Codify the requirements for data centers to pay for their own electric infrastructure costs
Ensure data centers add to the electric capacity, not just the demand
Require all new data centers be built with water-efficient technologies
Require large data centers to annually report electricity and water usage data to the PUC
Repeal sales tax exemptions and other outdated or unnecessary incentives for data centers
Reduce impacts on local communities by requiring setbacks, noise-reduction technology, etc.
