The Supreme Court just changed the game for freight brokers. And most carriers haven’t figured out what it means for them yet.

On May 14, the Court ruled 9-0 in Montgomery v. Caribe Transport II that freight brokers can be sued under state negligence law for hiring unsafe carriers.

The federal preemption shield that brokers hid behind? Gone — at least when it comes to carrier selection.
The ruling means brokers can no longer simply pick the cheapest or fastest option — they now face real legal exposure if they put a carrier with a poor safety record on a load.

Here’s what that means in plain terms:

For brokers: More scrutiny on every carrier they tender to. More documentation. More vetting. And a much harder conversation after any serious accident.

For carriers: Carriers with cleaner safety records and stronger compliance history become more valuable in broker relationships — while those with poor CSA scores or conditional ratings may find brokered freight lanes closing on them.
