We focus primarily on special needs planning for individuals and families with special needs, but also assist clients with all other aspects of estate planning and probate administration. ABLE accounts can be a very important piece of the financial puzzle for individuals with disabilities. One of the most frequent questions I receive from families is how will their loved one with a disability save money to buy the big assets that life often requires.
More education about ABLE accounts is definitely needed, but the biggest need in making this a successful program is to raise the eligibility age. Expanding the pool of individuals who can open ABLE accounts would allow more people to benefit from this great program and ensure the program remains sustainable.

I love Halloween. From wearing a costume to watching scary movies, I love everything about it. October 31 is one of my favorite days of the year. Fortunately, the monsters in most scary movies aren't real; there is no masked maniac terrorizing the neighborhood or boogeyman in the closet. And even if you feel a bit on edge after watching a scary movie, usually sleeping with the light on can allow you to drift off to sleep.
However, in my legal practice I've learned one issue that does keep people awake at night is worrying about what will happen to their loved ones in the future. Who will take care of my child with special needs once I am gone? Where will she live? Can my adult children, who rarely speak to each other, amicably split their inheritance without a third party evenly distributing the assets? These are truly the scary thoughts that make people, especially parents, lose sleep.
Enjoy this Halloween with your family, but please consider putting your estate plan in place so that you can get a good night's sleep as autumn leaves turn into winter snowflakes. Just don't forget to keep the light on after watching that Nightmare on Elm Street marathon.
