In honor of today, we express our heartfelt gratitude to those who have given their lives to protect our country. Did you know that the U.S. has passed laws that protect our servicemembers in the workplace? One of these have to do with hiring.
Check out what the EEOC says about this "fact" on hiring preferences:
"Although the ADA prohibits discrimination 'on the basis of disability,' it does not prevent affirmative action on behalf of individuals with disabilities. Thus, a private employer mayβbut is not required toβhire an individual with a disability who is qualified (including a veteran with a disability) over a qualified applicant without a disability.
In addition, the Vietnam Era Veteran's Readjustment Assistance Act (VEVRAA), which is enforced by the Department of Laborβs Office of Federal Contract Compliance Programs, requires that businesses with a federal contract or subcontract in the amount of $100,000 or more, entered into on or after December 1, 2003, take affirmative action to employ and advance qualified disabled veterans. VEVRAA also requires these businesses to list their employment openings with appropriate employment service delivery systems, and to give covered veterans priority in referral to such openings."

π· Happy Mother's Day to all the amazing moms out there! π· Let's take a moment to appreciate the hard work and dedication of mothers everywhere, who not only nurture their families but also play a crucial role in the workplace. Did you know that working moms are the norm?
β¨ 70 percent of moms with kids under 18 are part of the workforce, and over 75 percent of them work full-time.
β¨ In today's world, moms are the primary or sole earners for 40 percent of households with children under 18, compared to just 11 percent back in 1960.
Moms' strength, resilience, and multitasking abilities keep our families and economies running smoothly. Here's to all the incredible moms out there β you're truly superheroes! πΌπͺ
π©There is a common misconception that if you're salaried, you aren't entitled to overtime. In actuality, the analysis turns on whether you're an "exempt" salaried employee. The DOL provides for the exemptions here: https://webapps.dol.gov/elaws/whd/flsa/screen75.asp
π©For example, the Fair Labor Standards Act ("FLSA") has a "white collar exemption" that applies to administrative, executive and professional employees. That exemption only applies, however, if such employee hits the minimum salary threshold. Currently, that is $35,567. π That number will increase to $43,888 in July 2024, and to $58,656 in January 2025.

π Employment Tip: Know Your Rights Against Fraudulent Misrepresentation! π
Fraudulent misrepresentation in employment occurs when employers deceive you with false promises to lure you into joining or staying with them. Here's what you need to know:
π« What is it? It's when your employer deliberately lies about your job to get you on board or keep you around.
π Examples? Think promising a fat paycheck, bonuses, promotions, or cushy conditions but not delivering once you're in.
π€ What can you do? If you've fallen victim, you can fight back! File a claim against your employer for fraud. But proving it isn't easy, especially if it's just your word against theirs.
π‘ Tips: Keep records of promises, emails, or any proof. And remember, it's about showing they intentionally misled you.
β Watch out: Claims might be tough, especially if it's just a misunderstanding. But don't lose hope, justice can prevail!

This is a MYTH.
With regard to federal anti-discrimination laws, the EEOC says:
β
"If you have at least one employee: You are covered by the law that requires employers to provide equal pay for equal work to male and female employees.
β
If you have 15 to 19 employees: You are covered by the laws that prohibit discrimination based on race, color, religion, s*x (including pregnancy, s*xual orientation, or gender identity), national origin, disability and genetic information (including family medical history). You are also covered by the law that requires employers to provide equal pay for equal work.
β
If you have 20 or more employees: You are covered by the laws that prohibit discrimination based on race, color, religion, s*x (including pregnancy), national origin, age (40 or older), disability and genetic information (including family medical history). You are also covered by the law that requires employers to provide equal pay for equal work."
π©Additionally, keep in mind that many state have enacted anti-discrimination laws that may also apply to small businesses even if the federal anti-discrimination laws above do not all apply due to business size.
