What is a common problem in a divorce based upon adultery? Lack of proof!
What steps do you need to take to prepare a divorce case based upon adultery?
Adultery is one of several grounds for divorce in Alabama. Often times the act of adultery has taken place or has been ongoing long before you become aware of it. Obtaining the proof needed to show your spouse had an affair is not always easy. In a court setting, it is not what you know, it is what you can prove. Confronting a cheating spouse before you have secured clear evidence to prove the adultery occurred is often the wrong thing to do. If your spouse is cheating, do not confront them about it until after you have secured the evidence proving the adultery has occurred. Make a copy of your evidence and secure it in a safe location in the event your originals are lost, damaged or destroyed. By confronting a cheating spouse too soon you will likely blow your chances of obtaining the evidence necessary to prove your claim in court. Once your spouse knows you are suspicious, or are aware, of the adultery their conduct either stops or becomes more discrete thus making it harder or even impossible for you to obtain the proof you need. As long as your spouse keeps thinking they are "getting away with it" you still have a chance to get the proof. Having the "stone cold" proof can put you at a significant advantage over your spouse for the divorce to be settled quickly in your favor or even settling uncontestedβ¦
