Some individuals are not allowed to participate in pre-tax benefits (salary reductions) under a Premium-Only Plan or Cafeteria Plan. Generally, the following individuals cannot participate:
More-than-2% shareholders of a Subchapter S corporation and certain family members
Self-employed individuals
Partners in an LLP
Members of an LLC

Court cases brought on by mental health parity issues are on the rise, and they are not always aimed at the Third-Party Administrators or Insurers. Plan Sponsors may also be on the hook for these issues, especially if a complaint is filed against them by a plan participant.

-Partners in an LLP or Members of an LLC
