Here are the 2026 Changes in Pennsylvania traffic laws to take notice of.

Motorcyclist and Headphones:
Most drivers can’t wear headphones while driving in Pennsylvania. However, from Jan. 5 onward, motorcyclists can. The new law creates further exemptions for one or more headphones, earphones or helmets with built in speakers.

Pennsylvania’s distracted driving law will take full effect. Beginning June 5, 2026, under Paul Miller’s Law, police will be able to issue fines to drivers caught using handheld mobile devices behind the wheel. The change elevates the law from an educational phase to full enforcement, with violations carrying a $50 fine plus court costs and other fees. Officers may stop a vehicle solely for the violation, making it a primary offense.

Councilman Isaiah Thomas is advocating for a bill that would bar officers from pulling people over for minor violations.
With hard-won support of Philly’s top cop, the bill to ban minor traffic stops moves ahead. Another bill out of committee would also require police to record and maintain certain data regarding stops that could help determine how effective the interactions are in reducing crime.

The earliest these bills could be brought to a vote in council would be the end of the month.

They are believed to be the first municipal legislation of its kind.

We have had a number of calls asking whether the new driver's license suspension laws can help people who have been suspended in the past for the non-driving related violations.

Bad News ~ No, the law is not retroactive.
Good News ~ Change may be on the way.... Lawmakers continue to work on how to remedy the problem of people already in the cycle of driving on a suspended or revoked license.
