DiCello Levitt is proud to serve as outside counsel to the Commonwealth of Kentucky in consumer protection lawsuits filed by Attorney General Russell Coleman against Kalshi, Polymarket, and related entities over alleged illegal sports betting through so-called “prediction markets.”
The lawsuits allege that the platforms allowed Kentucky consumers to place wagers on game outcomes, point spreads, point totals, parlays, proposition bets, and player statistics while bypassing the Commonwealth’s licensing, consumer protection, and responsible gaming requirements.

BNP Paribas SA has been named a finalist for Public Justice’s 2026 Trial Lawyer of the Year Award, recognizing a landmark human rights victory on behalf of Sudanese refugees harmed by atrocities committed during the al-Bashir regime in Sudan.
We were honored to stand with Hausfeld, Hecht Partners LLP, and Zuckerman Spaeder LLP in this important case—the first trial in history to hold an international bank responsible for supporting genocide.

The U.S. Supreme Court today narrowed investors’ ability to bring private lawsuits under the Investment Company Act, ruling in favor of closed-end funds in a dispute over whether an activist investor could challenge fund bylaws that allegedly impaired its voting rights.
Marisa N. DeMato, head of our U.S. Securities Practice, weighs in on what the decision means for investor accountability:
“Today's Supreme Court decision is another step in a long-running trend of narrowing the ability of investors to hold corporate actors accountable. Private securities litigation has historically served as a critical supplement to SEC enforcement, and therefore when courts restrict private rights of action, as here, the practical effect is that it reduces accountability for issuers and market participants. In that sense, today's ruling can be viewed as yet another example of investor protections being curtailed. Indeed, this ruling comes against a backdrop in which mandatory arbitration clauses are eliminating class actions, policymakers are pushing to reduce the frequency of corporate disclosure, and governance structures increasingly favor insiders over public shareholders.”
