The NEC baby formula litigation primarily involves two major brands of cow's milk-based infant formulas:
Specifically, the lawsuits focus on formulas and human milk fortifiers derived from cow's milk that were given to premature infants.

Enfamil products:

The lawsuits allege that these cow's milk-based formulas increase the risk of necrotizing enterocolitis (NEC) in premature infants, and that the manufacturers failed to adequately warn about this risk.

Did you know a widely-used infant formula could be putting your baby at severe risk?
Recent lawsuits have exposed an unsettling truth: Some infant formula manufacturers are STILL using a product containing cow's milk and syrupโingredients that can lead to Necrotizing Enterocolitis (NEC). Tragically, each year, over 9,000 preterm infants are affected by NEC, and 25% of those babies don't survive. The worst part? A safer alternative has been available since 2006!
๐ฉโโ๏ธ NICU Nurses Are Doing Their Best โ This Isn't About Them ๐ฉโโ๏ธ
Let's be absolutely clear: This issue is not a reflection on the dedicated nurses in NICUs or your choices regarding breastfeeding. This is about formula manufacturers who continue to sell a dangerous product even when they know of a safer alternative.
๐ผ The SAFER Choice Exists! ๐ผ
Since 2006, a more reliable formula that DOES NOT contain cow's milk or syrup is on the market. This alternative formula has shown ZERO instances of NEC. Itโs a choice that could protect your baby from multiple surgeries or even save their life.

Multiple Surgeries At Birth. If premature infants are fed cow-based milk products, they can develop necrotizing enterocolitis (NEC), which is bacteria in the gut that causes inflammation in and death of the intestinal tissue.
08/01/2023
Necrotizing Enterocolitis, or NEC for short, is a sickness that affects a baby's stomach and intestines. It's sort of like a really bad tummy bug that can cause some parts of the baby's intestines to get sore and damaged. This disease mostly happens in babies who were born too early, known as premature babies. Still, sometimes, even babies who were born at the right time can get it.
Think of NEC as a tummy trouble that usually starts a couple of weeks after the baby is born, especially after they start drinking milk. This sickness is more common in very tiny babies - those who weigh less than about a small bag of sugar (3 pounds, 5 ounces) at birth. Since these little ones are not fully grown, their tiny tummies can get infections easily and have trouble digesting food or getting enough blood and oxygen. All of these problems make it easier for them to get NEC.
Sometimes, NEC can cause a hole in the baby's intestines. This is bad because the bacteria that usually live in the intestines, which are generally harmless, can leak out and cause an infection in the baby's tummy area. This damage can be in a tiny part of the intestine, or it can spread to bigger areas very quickly.
There isn't just one reason why a baby might get NEC. Being born too early and starting to eat too early when their tummy isn't ready are two big reasons. Also, babies who had a tough time being born and didn't get enough oxygen can get NEC.
Some people think that what's in baby formula or how fast it's given can cause NEC. While babies who drink breast milk can also get NEC, it happens less often to them.

Stomach Surgery
Recent studies suggest a disturbing connection between NEC in preterm infants (born before 37 weeks) and cow's milk-based formulas, including known brands like Enfamil and Similac. This suggests that the formula manufacturers were informed of these possible complications.
Each year, more than 9,000 preterm babies suffer from NEC, with 1 in 4 tragically losing their battle with this heartbreaking disease. The thought that this could be preventable is alarming.
If your preemie was fed these formulas and subsequently developed NEC requiring surgery, you may be entitled to financial compensation.

Research and advancements in neonatal nutrition over the years have paved the way to a significant shift in how we can prevent NEC in premature infants.
Back in 2006, after studies pointed out the increased risk of NEC associated with cowโs milk-based formula, a company called Prolacta Biosciences responded to the call. They developed a breakthrough product made entirely from human milk, specifically designed for premature infants. This was a game-changer in the fight against NEC.
The product is not just an alternative to cow's milk-based formula. It provides all the necessary nutrients required by premature infants and, importantly, significantly reduces the risk of NEC. Prolacta's human milk-based product is a testament to how science and innovation can address severe health issues. Since its introduction in hospitals in 2006, it has offered a protective nutritional option for premature babies who cannot access breast milk.
Following Prolacta's pioneering work, other companies like LactaLogics have also emerged, offering their own human milk-based products. This competition further emphasizes the recognition in the scientific and medical community about the benefits of human milk over cowโs milk-based formula for premature infants.
This shift in approach to neonatal nutrition, starting in 2006, has made NEC a preventable condition. It underscores the importance of human milk in protecting premature babies from this devastating disease, and the need for hospitals and caregivers to be informed about these beneficial options.

When it comes to feeding premature infants, breast milk is considered the gold standard. Human milk is rich in nutrients and also contains immune-boosting substances, like antibodies, which can help protect the baby's immature immune system. More specifically, breast milk contains components called human milk oligosaccharides (HMOs), which promote a healthy gut microbiome and inhibit harmful inflammatory responses, reducing the risk of NEC.
In contrast, infant formulas, especially those based on cow's milk, lack these protective substances. Cow's milk proteins are more difficult for babies to digest and are not as well-suited to a premature infant's immature digestive system. This mismatch can trigger an inflammatory response, leading to conditions like NEC.
Additionally, some formulas include corn syrup, which has also been linked to an increased risk of NEC. The precise reasons for this aren't entirely clear, but one theory is that it alters the gut microbiome in a way that promotes inflammation.
Companies have made efforts to create formulas that are easier for babies to digest, but these still don't match the benefits provided by human milk. In fact, formulas created entirely from human milk have been shown to significantly reduce the risk of surgical NEC in premature infants.
So, the issue with infant formulas and cow's milk lies in their lack of protective substances found in human milk, and their potential to trigger harmful inflammatory responses in the sensitive digestive system of premature babies, increasing the risk of NEC.
