Cars crashing into restaurants, convenience stores, and shopping centers is a common occurrence. The reasons why this happens varies and can be due to many factors such as inattention, mistake in shifting to park, foot slipping off the pedal or a medical illness or seizure. One common theme is the landowner or business fails to place any protection for the building from vehicle traffic (such as a bollard, rock, concrete wall).

After over a year of not having jury trials, Brazos County Court at Law No.1 conducted its first jury trial last week. Shurtleff Law was successful in obtaining a jury verdict in favor of our client Morgan Seekatz regarding permanent possession of her personal property (a dog!). We all love our dogs. They are part of our family right? Interesting side note on Texas law regarding damages available for the loss of a family pet: Can a dog owner recover emotional based damages for the loss of a dog? The Texas Supreme Court says no. The law says that pet loss (just like other personal property) is limited to the market value of the pet, and a court cannot award damages for loss of relationship, love or companionship.
