MPN as a defense can only be used if you do all you can to get the applicant into the MPN and give them all required notices.

Be sure to always push your MPNs. Consider the following:

1. Send out notice at time of injury.
2. Send to AA if represented and to applicant with a Proof Of Service.
3. Schedule an appointment with a MPN physician and send the appointment notice with Proof Of Service and mileage check to cover travel.
4. If they don't attend, file DOR to get MPN. (You can do this before the appointment scheduling if you don't wish to do that.
5. Always remember the PROOF OF SERVICE.

This is the best evidence to show you made all your attempts to get the MPN enforced on your end.
