For those of you who may not be aware, Boulder County District Attorney’s Office recently spoke out against the actions of ICE in deporting Jose Alejandro Lopez Gutierrez, a 56-year-old man with pending charges of s*xual assault on a minor. Shortly after being released on bond, Lopez Gutierrez was deported by ICE without the District Attorney’s Office having been informed. The actions of ICE are disappointing since the case will now be delayed and there is little to no chance Lopez Gutierrez will be prosecuted in the future. We agree with District Attorney Dougherty that ICE denied justice for the victim and jeopardized public safety. We also agree that the prosecution should have been given the opportunity to finish the criminal case, and that the defendant should have served his sentence prior to deportation. Para aquellos de ustedes que no están al día, la Oficina Fiscal de Distrito del Condado de Boulder se pronunció en contra de las acciones de ICE al deportar a José Alejandro López Gutiérrez, un hombre de 56 años con cargos pendientes por agresión s*xual a un menor. Justo después de ser liberado a baja fianza, López Gutiérrez fue deportado por ICE sin informar a la Oficina Fiscal del Distrito. Las acciones de ICE son lamentables ya que el caso va a ser retrasado y ahora no hay ninguna posibilidad de que López Gutiérrez sea procesado en el futuro. Estamos de acuerdo con el Fiscal de Distrito Dougherty en que ICE negó la justicia para la víctima y puso en peligro la seguridad publica. También acordamos que la acusación debería haber tenido la oportunidad de terminar el caso penal donde el acusado debía haber cumplido su condena y luego haber sido sujeto a deportación. Después de una larga y difícil batalla con inmigración nuestro cliente Nelsi se ha convertido en residente. Nelsi llegó a nuestra oficina pidiendo ayuda en el 2006.
