Latest news on Eviction Moratorium. It seems to IN PLACE for the time being.
The Appeals Court's Order (see below) provides a temporary administrative stay of the Housing Court's decision that found the Boston Eviction Moratorium invalid. The purpose of the stay is to give the Appeals Court time to review the documents filed and then to decide on a pending request for a longer stay. During the period of the administrative stay, the Boston Eviction Moratorium issued by the BPHC remains in effect to prevent landlords from evicting covered tenants in the City of Boston.
I wanted to make sure you and your members were aware of this Order so constables don't inadvertently violate the Moratorium. Again, what this means is that as of now, under the Moratorium, landlords cannot evict tenants, unless there are serious health and safety concerns. Therefore, constables should not be serving or posting 48-hour notices to remove tenants covered by the Moratorium from their homes.
